Influencers should not promote products if they have not used or understood them well.

Influencers are obliged to verify the credibility of the advertiser; check documents related to the advertised products, goods and services; in case they have not used or do not fully understand the products, goods and services, they are not allowed to introduce the products, goods and services.

On the morning of June 16, at the 9th Session of the 15th National Assembly , the National Assembly passed the Law amending and supplementing a number of articles of the Law on Advertising, with 453/461 delegates participating in the vote in favor (equal to 94.77% of the total number of National Assembly delegates).

This Law takes effect from January 1, 2026. Among the amended and supplemented contents are provisions on the rights and obligations of persons transporting advertising products.

Accordingly, the person delivering the advertising product has the right to be provided by the advertiser with truthful, complete and accurate information about the organization, individual, product, goods, service being advertised and documents related to advertising conditions; other rights as prescribed by law.

Regarding obligations, the person delivering the advertising product must comply with the provisions of the law on consumer rights protection and other relevant provisions of law on providing information related to the features and quality of products, goods and services when advertising; and fulfill tax obligations when generating revenue from advertising services in accordance with the provisions of the law on tax.

At the same time, provide documents related to advertising content when requested by competent state agencies; be responsible before the law in case the advertising content does not ensure the requirements as prescribed; perform other obligations as prescribed by law.

Notably, the Law supplements regulations on the obligations of the person who transmits advertising products who is an influential person in society.

In addition to the above obligations, influencers also have the following obligations: to verify the credibility of the advertiser; to notify about the advertising immediately before and during the advertising activity.

In particular, documents related to advertised products, goods and services must be checked; in case the product, goods or service has not been used or is not clearly understood, it is not allowed to introduce the product, goods or service.

In addition to the above contents, the Law also amends and supplements a number of provisions on prohibited acts in advertising activities and handling of violations in advertising activities.

Specifically, supplementing regulations prohibiting advertising contrary to historical traditions, culture, and social ethics; advertising comparing one's products, goods, and services with similar products, goods, and services of other organizations or individuals without legal documents to prove it.

Organizations and individuals who violate the provisions of this Law and other relevant legal provisions shall, depending on the nature and severity of the violation, be subject to disciplinary action, administrative sanctions or criminal prosecution; if causing damage, they must compensate according to the provisions of law.

The competent authority or person must be responsible for its handling decisions; in case of wrong decisions causing damage, compensation must be paid according to the provisions of law.
