While the whole country is tightening vehicle inspection activities to ensure traffic safety, in Son La, some vehicle inspection centers are still operating without completing legal procedures, and some places have even had their land leases expire since 2020... This situation poses a potential risk to traffic safety and shows loopholes in management.

Not yet connected to National Highway 6, risk of traffic conflict, that is the location of Son La Motor Vehicle Inspection Center (code 2601D) located in Noong La village, Chieng Sinh ward, started operating since 2016. This is the location right at the gateway, the beginning of the dual-track road into the center of the province, with very high traffic density.

According to the people's feedback, this center has not yet connected to National Highway 6 as prescribed. In fact, the area entering and exiting the center does not have a system of signs, painted lines, speed bumps, and other mandatory items when the connection point is officially licensed.

Article 43 of the 2008 Road Traffic Law (currently still in effect until the 2024 Road Law takes effect from January 1, 2026) clearly stipulates: “The connection of branch roads to national highways must be permitted by competent road management agencies; the connection location must ensure traffic safety and comply with approved traffic planning”.

Notably, a section of the median strip in front of the branch road leading to the center was cut out to serve Covid-19 epidemic control, but has not been returned to date, making this area like a "spontaneous" intersection, posing a potential risk of traffic accidents.

Speaking to reporters, Mr. Nguyen Duy Hoa, Chairman of the Board of Directors of Son La Vehicle Inspection Joint Stock Company, the unit managing the 2601D center, said: We are implementing the procedure to connect to National Highway 6. Currently, the center is temporarily connecting to the route of a previously licensed unit.

According to Decree No. 11/2010/ND-CP dated February 24, 2010 of the Government on management and protection of road traffic infrastructure, it clearly stipulates: "Organizations and individuals wishing to connect works and branch roads to national highways must prepare a dossier, have the competent road management agency appraise and approve the location, scale and form of connection before construction".

More than 130km from the old city center of Son La, the Motor Vehicle Inspection Branch 2603D, Van Ho commune is located right next to National Highway 6, Chieng Di slope, where there is often thick fog and limited visibility.

According to reports from 2018 until now, this branch is still operating despite not having a plan, not having a construction permit and not completing the connection procedures to National Highway 6.

Motor Vehicle Inspection Branch 2603D, Van Ho commune, located next to National Highway 6, has not been licensed to connect to the National Highway, with the risk of traffic conflicts between passing vehicles and vehicles entering and exiting the inspection area.

Mr. Nguyen Van Vinh, a driver who regularly travels on this route, said: This slope is already dangerous. When more vehicles enter and exit the inspection area, especially in foggy weather, just a small mistake can cause a traffic collision.

According to Clause 1, Article 89 of the 2014 Construction Law (amended and supplemented in 2020), it clearly states: "Before starting construction, the investor must have a construction permit issued by a competent state agency, except in cases of exemption".

In Article 7, Decree 10/2020/ND-CP dated January 17, 2020 of the Government on motor vehicle inspection service business, it is stipulated that: "Inspection enterprises are only allowed to operate after being granted a Certificate of eligibility for inspection activities, in which the location of operation must be consistent with the planning approved by the competent authority".

Chairman of the Board of Directors of Son La Vehicle Inspection Joint Stock Company, Mr. Nguyen Duy Hoa, explained: Branch 2603D is currently in planning conflict with public land. Initially, the project had an area of ​​2.9 hectares, but due to compensation problems, the unit proposed to adjust to 1.7 hectares for the cleared land area.

Operating without completing planning and traffic connection procedures is against the regulations. Pursuant to Clause 1, Article 12 of Decree 11/2010/ND-CP, all connection points to national highways must be assessed by the Ministry of Transport or the Department of Transport, and traffic organization plans must be approved, ensuring safety for vehicles entering and exiting.

More inadequacies are at the Motor Vehicle Inspection Center, Son La Waterway and Road Motor Vehicle Inspection Joint Stock Company (code 2602D), this center has been operating in the old Quyet Thang ward since 1997, now To Hieu ward, after equitization in 2017, it continues to use an area of ​​1,995m² of land rented from the State.

The Motor Vehicle Inspection Center, Son La Waterway and Road Motor Vehicle Inspection Joint Stock Company (code 2602D) has expired its land lease since June 2020, located next to the market, an area with schools and agencies and units.

It is worth mentioning that the land lease contract expired on June 15, 2020. However, the center has remained in operation for more than 4 years, located in a densely populated area, close to 7.11 market, Tran Quoc Toan primary school and central streets.

At one point, dozens of cars were lined up waiting for inspection, stretching all the way to the school gate, causing traffic congestion and disorder. Residents have repeatedly petitioned to move the center out of the residential area, but it has not been resolved.

Mr. Cam Viet Quan, Chairman of the People's Committee of To Hieu Ward, said: Son La City (before the separation) and the ward had submitted a document not to extend the land lease for the unit. They had sent documents twice to the Department of Natural Resources and Environment, now the Department of Agriculture and Environment, requesting to reclaim the land to expand the 7.11 market.

According to Mr. Quan, the relocation of this inspection center is reasonable, because it not only causes traffic congestion but also affects the urban environment and student safety. This is also the wish of voters and people for many years.

Mr. Nguyen Hai Son, Chairman of the Board of Directors of Son La Waterway and Road Vehicle Inspection Joint Stock Company, admitted: The unit has expired its land lease term, and has repeatedly requested an extension to have time to find new land funds, but it has not been approved. We still pay more than 500 million VND in land tax each year, but have not received any support.

Therefore, the fact that the 2602D center is still operating for many years after the land lease expired raises the question: Why did the authorities not renew the land lease or handle and temporarily suspend operations until legal procedures were completed?

Mr. Doan Manh Cuong, Director of To Hieu Ward Market Management Board, said: The policy of reclaiming the land area of ​​the center to expand the market is completely reasonable. The road to the market is currently very narrow, does not ensure fire prevention and fighting, and has no parking lot, affecting business.

According to Mr. Doan Manh Cuong, if the market is expanded, many spontaneous market places on the sidewalks will be eliminated, creating conditions to attract traders to return to business, contributing to restoring urban order. Currently, the second floor and many stalls inside the 7.11 market are empty because the entrance is inconvenient.

Speaking to reporters of Nhan Dan Newspaper, a representative of the Department of Construction of Son La province said that after receiving the feedback, the unit directed specialized departments to check and review all legal documents of the inspection centers in the area.

Centers that have not completed procedures, especially the connection to National Highway 6, will have to complete them in accordance with regulations. In case of failure to do so, the Department of Construction will propose the province to handle and suspend operations in accordance with the law.

In fact, the situation of many constructions and projects, including inspection centers, going into operation without meeting legal requirements is not unique in Son La. The practice of “doing first, asking later” makes state management passive, while traffic safety risks and planning violations are increasingly serious.

Obviously, the fact that vehicle inspection centers in Son La are still operating without legal procedures and violating regulations on connection, construction and land is a sign of laxity in inspection and supervision by relevant units.

Inspection centers are supposed to enforce technical standards and "guard traffic safety gates", but they themselves are not serious about complying with the law.

The problem is not only completing paperwork, but also the responsibility to ensure the safety of people's lives when vehicles enter and exit substandard areas, which pose a high risk of accidents.

In areas entering and exiting the inspection center that do not comply with connection regulations, there is a risk of traffic conflicts due to the lack of signs, road markings, and speed bumps as prescribed.

Son La people are waiting for specific actions from the provincial government and relevant departments and branches: Comprehensive review, request to correct violations, handle individual and collective responsibilities if violations persist.

From the story in Son La, it is time for other localities to tighten the licensing, inspection and supervision of inspection facilities in the area. Each center should only be allowed to operate when it has completed all procedures on planning, construction, connection and land, in accordance with the spirit of the law, contributing to "Not letting safe inspection places become unsafe places".
