The People's Committee of Nam Dinh province has just issued Decision No. 35/2024 regulating the conditions and minimum area for land division and consolidation in the locality. This regulation will take effect from October 1.
Regarding the demarcation of areas to regulate the minimum area allowed for land division in the province, area I includes land locations in wards of Nam Dinh city and existing towns.
Zone II includes residential land plots located along national, provincial, and district highways; and residential land plots located along commune-level main roads. In addition, it includes residential land plots in specific areas of Nam Dinh City, Truc Ninh District, Yen Yen District, Xuan Truong District, Giao Thuy District, and Hai Hau District.
Zone III comprises land plots located within the remaining zones.

In area I, with the land plot being a component part of a street or alley with a road width of over 2.5m, the residential land plot after being divided must have a minimum area of 30m2, a minimum frontage width of 4m, and a minimum depth compared to the construction boundary of 5m.
If the alley has a road width of less than or equal to 2.5m, it must have a minimum area of 45m2, a minimum frontage width of 4m, and a minimum depth compared to the construction boundary of 7m.
In areas II and III, the residential land plots after division have a minimum area of 50m2 and 80m2 respectively, with a minimum frontage width of 4m and a minimum depth compared to the construction boundary of 7m.
For commercial and service land, after subdivision, the minimum area must be 1,000m2, the minimum frontage width must be 15m, and the minimum depth compared to the construction boundary must be 20m.
For non- agricultural production land, the minimum area is 3,000m2, the minimum frontage width is 20m, the minimum depth from the construction boundary is 25m.
Regarding transitional provisions, for land parcels currently in use or subdivided land parcels with a residential land area smaller than the minimum residential land area, which existed before June 27, 2013 but meet the conditions for granting a land use right certificate, the current land user will be granted a certificate.
