
Petition for enforcement of judgment
At the citizen reception, Mr. Vo Van Thien (residing in Da Nang ) petitioned about the case related to the enforcement of Judgment No. 79 dated November 28, 2019 of the People's Court of Quang Nam province on the real estate transaction between Mr. Thien and Chi Thanh Company Limited at the projects of Urban Area No. 6 and Urban Area No. 11 (Dien Nam - Dien Ngoc New Urban Area, Dien Ban) invested by Chi Thanh Company Limited.
According to the verdict, Chi Thanh Company Limited must return to Mr. Thien more than 2.1 billion VND; the joint obligation with Notary Office No. 1 of Quang Nam province is to compensate Mr. Thien for more than 8.7 billion VND. Although the verdict has been in effect for nearly 5 years, he has yet to receive the assets returned by Chi Thanh Company.
Mr. Vo Van Thien requested the Provincial People's Committee to promptly issue a document directing the resolution of the prolonged matter, which has affected his rights. At the same time, he requested the Provincial People's Committee to direct the resolution of the issue that the enforcement agency has been freezing the account of Notary Office No. 1 with an amount of more than 436 million VND at the State Treasury since November 10, 2022, but has not yet organized the enforcement of the judgment for him.

According to the representative of the Civil Judgment Enforcement Department of Quang Nam province, this is a long-standing and complicated case, with many obstacles in the seizure of assets to enforce the judgment. The reason is that Chi Thanh Company Limited is facing many difficulties, debts and the residential areas invested by this company are also buying and selling assets.
After listening to the opinions of relevant departments and branches, Chairman of the Provincial People's Committee Le Van Dung agreed to assign the Provincial Civil Judgment Enforcement Department to seize assets related to Chi Thanh Company Limited to promptly execute the judgment, ensuring the rights of Mr. Vo Van Thien. At the same time, the Department of Planning and Investment and relevant agencies were assigned to monitor, inspect, and advise the Provincial People's Committee to take measures in accordance with legal regulations.
Mr. Le Van Dung also assigned the Department of Justice to study and consider asking for the Ministry of Justice's opinion on adjusting measures to handle responsibilities for notaries who violate the law, and promptly advise the Provincial People's Committee on a handling plan. The case must be resolved by the end of December 2024 at the latest, ensuring legitimate interests for people and businesses.

Also at the citizen reception, Chairman of the Provincial People's Committee Le Van Dung and representatives of relevant departments and branches had a meeting with 3 parties related to the projects of An Duong Trading and Service Company Limited, Dai Viet Company Limited, and Phuoc Nguyen Service Company Limited.
Mr. Bui Hong Hanh (residing in Da Nang, representative of the citizen group) proposed: Previously, the citizen group had signed land purchase contracts from 2017 - 2018 and paid up to 95% of the contract value at the projects Dai Duong Xanh, Coco Riverside, An Phu, Phu Thinh, Dien Thang Trung, Anh Duong, Binh An, Ha My Complex Urban Area, Duong Hoi, Indochina, by Mr. Do Tan Vu - Director and legal representative of the enterprises: An Duong Trading and Service Company Limited, Dai Viet Company Limited, Phuoc Nguyen Service Company Limited in Dien Ban. However, up to now, the citizens have not received the land use right certificates. Mr. Bui Hong Hanh proposed that the Provincial People's Committee promptly direct the settlement to ensure the rights of the people.

Chairman of the Provincial People's Committee Le Van Dung shared the frustration of the people when the incident was prolonged, and acknowledged that An Duong Trading and Service Company Limited had cooperated with all parties to resolve the incident. However, Mr. Dung said that this was a case with many complicated factors, leading to a prolonged situation and not being resolved completely.
Chairman of the Provincial People's Committee Le Van Dung requested An Duong Trading and Service Company Limited to promptly complete the procedures and obligations related to the project to soon issue land use right certificates to the people. Mr. Le Van Dung assigned the Department of Natural Resources and Environment to work directly, guide and urge the companies to complete the related contents and obligations, gradually resolve the problems, and ensure the rights of the people.
At the same time, the People's Committee of Dien Ban town was assigned to coordinate with An Duong Trading and Service Company Limited to carry out compensation and site clearance in accordance with regulations; strengthen management of construction order, and prevent illegal expansion, encroachment, and construction in the project area.
Mr. Le Van Dung affirmed: “The government shares the concerns about the rights of the people, as well as the difficulties of businesses. All parties must be calm, share the difficulties together, the goal is to resolve to ensure the legitimate rights of the people and businesses in a transparent and legal manner. The relevant agencies of the province need to fully support, guide and urge all parties to perform their tasks in accordance with regulations to promptly resolve the problems, ensuring the interests of the people.”
