Dien Bien Phu City is currently undergoing rapid urban development, leading to an increased demand for construction projects and housing.

Repeatedly discovered violations

In late October, authorities in Dien Bien Phu City, in coordination with the Thanh Binh Ward People's Committee and representatives of residential group 1, conducted an inspection and issued a report to prevent violations of construction regulations by Mr. PVT's family. It is known that Mr. T.'s family leases land from the Thanh Binh Ward People's Committee for business purposes. During their operation, Mr. T. arbitrarily expanded and erected a corrugated iron-roofed structure on an area of ​​504.1 square meters without obtaining the necessary permits.

Upon inspection, authorities determined that this land belonged to a planned project, and that Mr. T.'s actions were illegal. They therefore stopped him and ordered his family to dismantle the structure.

Mr. T shared: “Because I was unaware of the legal regulations, I thought that since I was leasing the land, I was allowed to erect structures to serve my business needs. After hearing the explanation, I understood that my actions violated the law. Therefore, I commit to dismantling the structures and restoring the land to its original state. For now, I hope that the relevant authorities and local government will consider and create favorable conditions for my family to conduct business while waiting for the project to be completed.”

Another, more complex case of construction order violation, requiring coercive measures, involves the family of Mr. D.T.T., residing in residential group 3, Muong Thanh ward. On July 11, 2024, the People's Committee of Dien Bien Phu City issued Decision No. 04/QD-XPHC regarding administrative penalties against Mr. D.T.T. for encroaching on 475.7 of non- agricultural land in an urban area. On this land, Mr. D.T.T. had built a level 4 house, a temporary shed, and cultivated trees and crops.

Authorities determined that the encroached area had been reclaimed by the People's Committee of Lai Chau province (now Dien Bien province) according to Decision No. 559/QD-UB, dated May 12, 2003, and in 2007, Him Lam Cooperative handed over the land to the Lai Chau Provincial Specialized Construction Project Management Board for use in constructing dams, embankments, and infrastructure for the Nam Rom riverside park. According to the decision, Mr. D.T.T. was fined 30 million VND and required to take remedial measures, including demolishing the structures, removing trees and crops, relocating assets on the land, and restoring the land to its original condition before the violation.

However, Mr. D.TT only agreed to dismantle the structures and buildings on the land himself, but refused to hand over the land. Therefore, the City People's Committee had to enforce the demolition of the structures, clear the remaining trees on the land, and hand it over to the Muong Thanh Ward People's Committee for management according to regulations.

Authorities announced the decision to forcibly evict the family of Mr. D.T.T., residing in residential group 3, Muong Thanh ward.

Prevent it from the very beginning.

As the political, cultural, and social center of the province, Dien Bien Phu City has a high population density and a high demand for housing, which naturally leads to complex violations of construction regulations. According to authorities, the main violations include: using land for purposes other than those permitted; constructing buildings without permits, exceeding permitted limits, and construction not conforming to approved plans…

Mr. Nguyen Kim Lan, Team Leader of the City's Urban Order Management Team, stated: "Preventing violations is difficult because violators often choose holidays, weekends, or secretly carry out the work at night. Most cases of illegal construction involve households facing housing difficulties, and the construction serves as their only residence or production facility, making the process of persuading them to dismantle the structures complicated. Meanwhile, the area has many planned projects that have not been implemented or are being implemented slowly, leading to certain impacts on people's lives and production needs, and also creating difficulties for management."

Authorities are enforcing regulations against a case of construction violation in the city.

With a determination to prevent and address violations from their very inception, minimizing the need for corrective action and bringing construction activities in the area into order, the city has issued numerous directives in recent times. The focus has been on tightening inspection and enforcement to promptly detect and prevent any signs or acts of violations. Functional forces and the People's Committees of communes and wards have effectively coordinated in inspecting and supervising construction activities.

In line with this policy, construction projects in the area are inspected and supervised from the commencement to completion and commissioning (except for state secret projects and national defense and security projects). Through this, administrative violations are detected and prevented promptly from the outset, minimizing the need for enforcement actions.

For example, in Thanh Minh commune, the People's Committee has established a team to inspect land management and construction order. The team members include commune officials and representatives from all 12 residential areas and villages in the commune. The main task of the team is to maintain regular and continuous inspection activities in the area; conducting cross-patrols or parallel patrols with city-level functional forces. This allows for the timely detection of cases showing signs of violations in order to prevent and handle them.

According to statistics from the beginning of the year to date, the Urban Order Management Team of Dien Bien Phu City has coordinated with functional forces and the People's Committees of communes and wards to inspect 265 cases. Of these, 250 cases involved construction in accordance with the issued permits; functional forces recorded on-site inspections and promptly prevented violations in 12 cases; and coordinated with the People's Committees of wards to record administrative violations in 2 cases. In addition, through inspections of 26 other cases, on-site inspections were recorded, preventing violations of land management and use in 23 cases; and administrative violations were recorded in 3 cases.
