On the afternoon of November 6, National Assembly deputies discussed in groups the draft Law on Digital Transformation, the Law on High Technology (amended) and the Law on amending and supplementing a number of articles of the Law on Technology Transfer.

There must be a legal framework for a digital nation.

Speaking at the Ho Chi Minh City delegation, delegate Vu Hai Quan - Permanent Deputy Minister of Science and Technology - said the reason for building a separate law on digital transformation is to institutionalize resolutions. In particular, the current context requires a legal framework for a digital nation.

"The digital nation includes political systems and socio-political organizations, including the National Assembly, Central Party Committees, the Government, the Fatherland Front, ministries, and localities. We must institutionalize the components of the digital transformation system in the law, that is, legalize those contents," Mr. Quan analyzed.

On the other hand, according to Mr. Quan, the law also focuses on solving the problem of funding investment for digital transformation. This is the biggest bottleneck, because most projects on digital transformation and administrative services are facing difficulties and obstacles in funding sources.

Along with that, the bill will promote the development of the digital economy, digital society and digital culture. The law also addresses the issue of fairness and the digital gap between different regions, ensuring basic rights to access digital services and supporting the development of the digital economy.

Also contributing comments to the bill, delegate Nguyen Tam Hung (HCMC) said that the bill stipulates prohibited acts.

He proposed adding regulations to clarify behaviors such as using digital transformation technologies and tools to create or spread fake information and harmful content that affects the reputation, politics, and economy of the country or organizations and individuals.

According to Mr. Hung, currently, technology to spread fake information and other artificial intelligence (AI) tools to generate content are developing rapidly and have the potential to cause much more serious consequences than regular false content.

Mentioning specific acts of using this technology to create fake news would help increase deterrence and legitimize the control of new technological threats.

"This requires international cooperation to prevent and maintain social stability and avoid spreading bad and toxic information among the people," Mr. Hung commented.

Delegate Nguyen Thi Le (HCMC) said the draft Law on Digital Transformation has provisions to ensure network safety, security, and personal data protection. However, in reality, people are concerned about data leaks when making online transactions.

Delegates proposed adding compensation responsibilities for state agencies and businesses when data leaks occur, and establishing a mechanism to warn people about cybersecurity violations, similar to warnings about banking transactions.

On the other hand, according to Ms. Le, the bill has mentioned the responsibilities of digital platforms and users.

However, in reality, many cross-border e-commerce platforms find it difficult to control the quality of goods, affecting consumer rights.

She proposed adding a requirement that platforms not headquartered in Vietnam must have a legal representative in the country, publicize algorithms, and be responsible for goods and services traded in Vietnam.

"In addition, there should be preferential credit policies and digital skills training for business households and small and medium-sized enterprises to participate in the digital economy, in line with the draft law's direction," said Ms. Le.

Specify policies to create and support start-up businesses

Delegate Tran Hoang Ngan (HCMC) said he agreed that the high-tech agricultural zone must be retained, because the 2008 Law on High Technology has detailed regulations to clearly show the important role and advantages of Vietnam's agricultural sector.

According to Mr. Ngan, if invested in high-tech agriculture, the advantages will be even clearer, and it will also be an important endogenous driving force, ensuring social security and autonomy.

According to Mr. Ngan, the bill must consider institutional issues and the autonomy of high-tech zones. Specifically, the decentralization and delegation of authority to this high-tech zone must be large enough.

Incentive policies must be extremely clear and transparent so that science, technology and innovation become truly important driving forces, aiming to achieve the target of double-digit economic growth in the 2026-2030 period and vision to 2045.

Delegates believe that the implementation of Resolution 68 of the Politburo and Resolution 198 of the National Assembly on special policies for the private economy, access to land, access to social resources for science and technology development... must be given priority to the private sector.

Those contents need to have regulations and decrees attached to this law to be more feasible.

"I am very interested in policies to create and support start-up businesses related to tax, fee, and credit policies, including access to capital in the financial market at the international financial center that we are preparing to issue," Mr. Ngan said.
