It is crucial to strictly address fraudulent acts of "charity disguised as charity" during the flood season to maintain public trust and uphold the rule of law.

The fact that the Central Committee of the Vietnam Fatherland Front (VFF) has continuously posted thousands of pages of bank statements showing donations to people affected by Typhoon No. 3 through Vietcombank account number 0011001932418 has attracted the attention and approval of public opinion.

Transparency and recognition

Beyond ensuring transparency in fundraising and honoring the generosity of benefactors, the publication of the Vietnam Fatherland Front's financial statements also demonstrates the serious implementation of Government Decree 93/2021/ND-CP on the mobilization, receipt, distribution, and use of voluntary contributions to support the overcoming of difficulties caused by natural disasters, epidemics, and incidents; and to support patients with serious illnesses.

Accordingly, individuals and organizations soliciting voluntary contributions are responsible for fully, promptly, and accurately disclosing all activities related to the solicitation, receipt, distribution, and use of these voluntary contributions.

The statement of donated funds must be published no later than 15 days after the end of the donation period. Individuals and organizations soliciting voluntary contributions are also responsible for publicly disclosing the total amount distributed and used no later than 30 days after the end of the distribution and use period.

Violation of ethics and law

Then, following the ethical and legal release of bank statements by the Vietnam Fatherland Front, the online community discovered many cases where individuals had exploited the situation of calling for support for their compatriots to heartlessly edit images and inflate the amount of money donated in order to create a false reputation on social media.

The concept of "VAR check" on bank statements emerged to refer to the process of verifying information about the amount of contributions announced by individuals or organizations.

The list of individuals who engage in ostentatious and pretentious acts of charity is growing longer, even including some previously well-known figures.

The act of exploiting charitable activities and intentionally creating "misunderstandings" about the amount of donations not only demonstrates the dishonesty of individuals seeking fame and damages public trust, but also shows signs of violating the law.

Perhaps, when engaging in such unethical and self-serving acts of fame-seeking, the individuals who were singled out by the online community were unaware of the possibility that they might be violating the law.

Accordingly, in cases of altering charitable donation transfer statements, as stipulated in Article 101 of Government Decree 15/2020/ND-CP, providing false, distorted, or defamatory information may be subject to administrative penalties ranging from 5 to 10 million VND.

Notably, the act of falsifying bank statements and soliciting charitable donations without transferring the promised amount can be severely punished under Article 175 of the 2015 Penal Code. Article 175 stipulates the crime of abuse of trust to misappropriate property, with a prison sentence of up to 12 years.

Given recent developments, it is clear that authorities need to implement strict deterrent sanctions against fraudulent acts disguised as charity.

Addressing violations will help maintain fairness in fundraising and relief efforts and strengthen the trust of donors in particular and the public in general.

Individuals and organizations engaged in charitable activities need to further enhance transparency in the collection, management, and allocation of donated resources.

In addition to providing bank statements showing incoming funds, charitable organizations also need to provide proper documentation for the disbursement of relief funds to ensure they are used for the right purposes and reach the right recipients, in order to build trust within the community.

Finally, the general public, and especially generous donors, need to be vigilant and direct their love appropriately; always thoroughly research and verify information related to charitable organizations before participating in donations. Having a generous heart is good, but that good heart must reach the right place, avoiding falling into the trap of fraudulent organizations.
