According to the Department of Construction, in August 2022, the People's Committee of Tánh Linh district issued a document requesting the demolition of the illegal construction, or the illegal part of the construction, belonging to Mr. CTS (residing in Hamlet 1, Gia An commune, Tánh Linh district).
Upon inspection, it was found that the structure was not demolished as instructed in the aforementioned document, but was instead completed and put into use, causing negative public opinion in the locality.
"The Department of Construction proposes that the People's Committee of Tánh Linh district immediately organize the demolition of Mr. S's construction violating building regulations."
Simultaneously, hold accountable the organizations and individuals involved in the aforementioned violations. The results of handling violations of construction regulations will be reported to the Department of Construction before October 30, 2024," the official document stated.
The villa's fence has been built.
According to the case file, Mr. S's "mansion," built on an area of thousands of square meters on the frontage of Provincial Road 717 in Gia An commune, Tanh Linh district, was started in 2022.
In March 2022, the Chairman of the People's Committee of Tanh Linh District issued a decision to impose administrative penalties on Mr. S for committing an administrative violation by constructing a building without a construction permit.
The district requires that, within 90 days from the date of issuance of the administrative penalty decision, Mr. S must complete the application for a construction permit as prescribed.
However, inspections have revealed that the deadline has passed, and the homeowner has failed to complete the application for a building permit from the competent authority, continuing to commit violations.
In August 2022, the Chairman of the People's Committee of Tánh Linh District requested the People's Committee of Gia An Commune to issue a notice requiring the homeowner to demolish the illegally constructed building or part thereof.
If Mr. S fails to comply within the specified time, enforcement action will be taken in accordance with the law.
To date, the owner of the illegally constructed building has not only failed to voluntarily dismantle it but has also built a solid fence and completed the illegal construction.
