According to Neowin , in a press release regarding the lawsuit, the FTC stated that Adobe has earned the majority of its revenue from subscription packages for over a decade. However, the FTC claims the software company is trying to encourage customers to subscribe to what they call "monthly annual payments." Each month, the customer's credit card or bank account would pay for the package, but it would cover the entire year.
Adobe faces a series of allegations from the FTC.
Furthermore, the FTC alleges that when customers attempt to cancel their Adobe subscription before the one-year period ends, the terms require them to pay a high early termination fee, up to 50% of their remaining monthly payment. More notably, the FTC claims these terms are printed in small print on Adobe's website or require customers to hover over small icons to learn more information.
The FTC stated that it had received complaints about this situation from numerous customers, and added that Adobe was aware of the complaints but continued with this subscription structure and concealed early termination fees.
Furthermore, the FTC stated that Adobe made it very difficult for customers to cancel their subscriptions. The agency stated: "When customers attempted to cancel their subscriptions on the company's website, they were forced to navigate multiple pages to cancel. When they contacted Adobe customer service to request cancellation, they encountered resistance and delays from Adobe representatives. Customers also faced other obstacles, such as interrupted calls and chats, as well as multiple transfers. Some customers who successfully canceled their subscriptions reported that the company continued to charge them until they discovered the charges on their credit card statements."
According to the FTC, Adobe's actions violate the "Online Consumer Trust Restoration Act " in the United States. In addition to the company, the lawsuit names two Adobe executives: Maninder Sawhney, Senior Vice President of Digital Marketing and Sales, and David Wadhwani, President of the Digital Media Business.
Adobe has not yet responded to the lawsuit.
