
Entering the new development phase of 2026 - 2030, the Ministry of Industry and Trade aims to promote the improvement of institutions, policies and laws in the fields of trade, industry and energy to create a synchronous, modern legal corridor suitable to the requirements of rapid and sustainable development of the economy. This is considered a strategic step, contributing to concretizing the major Resolutions of the Politburo , realizing the goal of building a socialist rule-of-law state in the era of digital transformation, green economy and deep integration.
According to the Department of Legislation (Ministry of Industry and Trade), based on the outstanding achievements of nearly 40 years of innovation and the results of the administrative reform revolution and the improvement of national governance efficiency strongly implemented in the 2021-2025 period, Vietnam's economy is expected to continue to maintain a reasonable growth rate, associated with improving quality, efficiency and sustainability.
The period 2026 - 2030 is forecast to be an important and strategic period in the process of developing the country in a fast and sustainable direction, realizing the goals set out in the 10-year Socio-Economic Development Strategy 2021-2030, especially the implementation of revolutionary strategic decisions, posing many new issues and new, higher requirements. At the same time, this is also a new turning point, a new historical opportunity in the era of national development.
In particular, the Politburo has recently issued 4 Resolutions: Resolution 57-NQ/TW; Resolution 59-NQ/TW; Resolution 66-NQ/TW and Resolution 68-NQ/TW, forming 4 pillar Resolutions, which are important milestones in the process of institutional improvement, and a strong driving force to move our country forward in the new era. These are strategic orientations that not only have immediate institutional reform significance, but also lay a long-term foundation for building a modern, effective, efficient and humane rule of law for the coming period.
In addition, the growth momentum continues to come from the dynamic private sector, rapid urbanization, abundant young labor resources, and effective utilization of new-generation free trade agreements (FTAs). Major infrastructure and transportation projects will be completed during this period, which is a positive factor for economic development. Some large foreign direct investment (FDI) projects that have begun to enter stable production will contribute to changing the economic and export structure.
New requirements for growth model transformation, climate change adaptation, energy transition, digital economic development, green economy, circular economy, etc. will be strong driving forces to promote economic restructuring and perfect national development institutions.
The process of building legislative orientations for the 2026 - 2030 period has been carried out urgently and resolutely by the Legal Affairs Department, members of the Working Group and relevant units. At the same time, closely following the Resolution of the Party Congress and documents, resolutions, conclusions and directives of the Central Executive Committee, the Politburo, the Secretariat for the 2021-2025 period; 4 breakthrough resolutions: Resolution 57-NQ/TW, Resolution 59-NQ/TW, Resolution 66-NQ/TW, Resolution 68-NQ/TW; closely following the draft documents of the 14th Party Congress. At the same time, continuing to concretize the Constitution, resolutions of the National Assembly, directions of the Government and the Prime Minister in the new period; results of implementing the Orientation of the Law-making Program for the 15th National Assembly term; Practical issues requiring amendments, supplements or promulgation of new laws, resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee.
The Party and State's policies, guidelines and orientations related to the building of institutions and laws related to the industrial and commercial sectors in the 2026-2030 period all aim to build and perfect the socialist rule-of-law State in the new development period, in the context of the country promoting industrialization, modernization, innovation, digital transformation and sustainable development.
Accordingly, the Ministry of Industry and Trade will amend and supplement a number of laws in the fields of commerce and industry, including: the 2005 Commercial Law; the 2017 Foreign Trade Management Law; the 2023 Consumer Rights Protection Law; the 2024 Electricity Law; and review "bottlenecks" and obstacles in the implementation of a number of laws: the 2018 Competition Law; and the 2024 Electricity Law.
Among them, focusing on reviewing and amending a number of regulations on decentralization, delegation of power, and division of authority in the fields of industry and trade in the Laws to ensure the smooth operation of the two-level local government model, promoting the initiative and creativity of local governments in socio-economic development in the new context according to the Party and State's policies and guidelines on innovating the organization of the State apparatus to be streamlined, effective, efficient and consistent with the content of the 2013 Constitution and Resolution 203/2025/QH15 of the National Assembly amending and supplementing a number of Articles of the 2013 Constitution.
Perfecting commercial law to fully institutionalize the rights and obligations of parties in commercial business activities in accordance with operational practices, development trends and international practices as well as the context of the 4.0 industrial revolution, encouraging the development of commercial infrastructure.
Strongly shift from pre-inspection to post-inspection associated with strengthening inspection and supervision. Shift the management of business conditions from licensing and certification to publishing business conditions and post-inspection, except for a few fields that are required to carry out licensing procedures according to regulations and international practices under Resolution No. 68-NQ/TW dated May 4, 2025.
Review and complete the policy and legal framework on import and export to effectively exploit signed FTAs; develop and complete policies and legal frameworks to facilitate import and export through digital platforms; develop and complete policies to promote official import and export under contracts for border trade associated with strengthening inspection, control and combating trade fraud according to Decision No. 165/QD-TTg. In addition, complete laws and policies on trade defense, consider amending relevant legal documents in the field of trade defense or research and develop a Law on Trade Defense.
In the period of 2026 - 2030, the Ministry of Industry and Trade will review and complete the Market Management Ordinance to meet the requirements in the new context. Specifically, amend and supplement regulations to meet the requirements of implementing the policy of streamlining the political system's organizational apparatus, arranging administrative units, associated with decentralization and delegation of power in the Resolution of the 13th National Party Congress of the Party and Resolution No. 66-NQ/TW, Resolution No. 27-NQ/TW.
The completion of institutions, policies and laws for the 2026 - 2030 period is not only a technical legislative requirement, but also a strategic step to build a modern socialist rule of law, adapting to the context of global integration and digital transformation. The Ministry of Industry and Trade determined that the review and amendment of the legal system in the field of industry and trade will continue to be carried out comprehensively and synchronously, ensuring consistency, feasibility and transparency, contributing to building a favorable investment and business environment, improving national competitiveness and promoting sustainable economic development.
