The Ministry of Home Affairs proposed to provide compensation for officials when streamlining the apparatus.

Regarding the amendment of Decree 178, in cases where lower benefits or policies have already been implemented, compensation will be provided to ensure the rights of beneficiaries are protected during the restructuring of the administrative apparatus.

The Ministry of Interior has drafted a Decree amending and supplementing several articles of Government Decree No. 178/2024 on policies and regulations for officials, civil servants, public employees, and members of the armed forces in the implementation of the restructuring of the political system's apparatus.

In addition to expanding the scope of beneficiaries of the policy, the draft Decree amends and supplements regulations regarding its effective date.

Accordingly, those eligible for policies and benefits as stipulated in the draft Decree No. 178/2024 who have already received benefits from competent authorities under Government Decree No. 29/2023 (regulating downsizing of personnel) since January 1st will be compensated according to the new policies and benefits.

For cases where the competent authority has already resolved the policy and regulations according to Government Decree No. 177/2024 (regulating the regime and policies for cases of non-re-election, re-appointment, and officials who resign or retire voluntarily) from January 1st until before the draft Decree No. 178/2024 comes into effect, if the policy and regulations are lower than the prescribed policy and regulations, then compensation will be provided according to the policy and regulations.

The draft Decree No. 178/2024 also clarifies that cases where competent authorities have decided on early retirement before January 1st, as stipulated in Government Decree No. 21/2009 (detailing and guiding the implementation of some articles of the Law on Officers of the Vietnam People's Army on regimes and policies for officers ceasing active service; officers on active service who die or pass away; officers on active service transferring to professional military personnel or defense civil servants); and Government Decree No. 151/2016 (detailing some articles on regimes and policies of the Law on Professional Military Personnel, Defense Workers and Civil Servants); Government Decree No. 32/2013 (detailing and guiding the implementation of some articles of the Law on Cryptography regarding the regime and policies for cryptography personnel) applies to individuals whose entitlements and policies have not been resolved by the competent authority since January 1st, but who have not yet received a decision from the competent authority.

In January, the Ministry of Interior issued Circular 01/2025 guiding the implementation of policies and regulations for officials, civil servants, public employees, and workers in the restructuring of the political system's organizational apparatus.
