
At the Lam Dong province's meeting point, Vice Chairman of the Provincial People's Committee Nguyen Ngoc Phuc presided. Attending the meeting were leaders from the following departments and agencies: Finance, Agriculture and Environment, Justice, Construction, Provincial Inspectorate, and Provincial Tax Department.
In his opening remarks, Deputy Prime Minister Tran Hong Ha stated that the process of drafting sub-legal documents related to finance, land, etc., may not be entirely clear. These policies could pose difficulties for local authorities in their implementation.
Therefore, in the spirit of listening and focusing on the grassroots, today the Government is meeting to review two Decrees regulating the Land Development Fund when the Land Law comes into effect. The aim is to unify and issue clear mechanisms to facilitate implementation by citizens, businesses, and localities…

The Prime Minister requested that feedback from localities and associations, which have directly addressed the issues of the people and businesses, be taken into account. Reflections regarding impacts, implementation methods that are unsuitable for the actual situation or specific target groups, or rigid and inflexible documents, will be revised and supplemented. The goal is to ensure that the documents comply with the law and are implemented appropriately for each target group.
The Deputy Prime Minister also requested that land finance policies become increasingly transparent and clear, ensuring the rights of the State, the people, and businesses. Land finance policies cannot be about exploiting land resources excessively, but rather about putting them into practice. Production must be appropriate, with appropriate costs… Regarding the responsibilities of land users, there must also be a suitable roadmap to avoid unreasonable application.
The Deputy Prime Minister explained that the approach to land management needs to be considered to avoid land speculation, waste, and inefficient land use, while protecting the rights of the people. It is necessary to avoid situations where land is wasted or subject to excessive fluctuations. Policies may be correct, but implementation faces obstacles; these need to be reviewed to create value and ensure economic, political, and social viability.
Regarding the additional fees to be paid, the Deputy Prime Minister requested the Ministry of Finance to address each issue individually. This includes identifying the obstacles posed by the Decrees for localities and businesses. Furthermore, it is necessary to exclude cases of violations by businesses or by the State... In particular, an analysis must be conducted to determine why the fees should be collected and why they should be reduced, ensuring a balance of interests between the State and land users.
Minister of Finance Nguyen Van Thang also presented the draft amendments and additions to Decree 103 and Decree 104. Accordingly, Decree 104 is only technical in nature, while the main focus remains on Decree 103.
After synthesizing, incorporating, and explaining the opinions, suggestions, and proposals from ministries, sectors, localities, organizations, associations, and businesses, the Ministry of Finance has finalized the draft Decree. To date, the Appraisal Council has conducted an appraisal of the draft Decree. Currently, only 18 out of the 63 former provinces (190 projects) nationwide have calculated land use fees and additional payments.
The Ministry of Finance currently has three draft proposals regarding the issue of supplementary land use fees: maintaining the current rate, reducing the amount, or waiving the supplementary fee. The calculation period is approximately 180 days.
However, according to local leaders, there are cases where payments have been delayed for up to 10 years. These delays are due to issues following audits, planning regulations, and problems with the appraisal unit… The reasons stem from both the project owner's capacity and inspection and auditing processes…
