(NLĐO) - The government has proposed adding officials, civil servants, and public employees to the list of eligible participants in United Nations peacekeeping forces.
On the afternoon of March 14, continuing the program of the 43rd Session, under the chairmanship of Deputy Speaker of the National Assembly Tran Quang Phuong, the Standing Committee of the National Assembly gave its opinion on the draft Law on Participation in United Nations Peacekeeping Forces.

Presenting the report, General Nguyen Tan Cuong, Chief of the General Staff of the Vietnam People's Army and Deputy Minister of National Defense, stated that the drafting and promulgation of the law is necessary to fully institutionalize the Party's guidelines and policies on Vietnam's participation in United Nations peacekeeping operations, further institutionalize the provisions of the 2013 Constitution and international commitments to which Vietnam is a member regarding participation in UN peacekeeping operations, and create a complete, solid, long-term, and stable legal framework for deploying forces to participate in UN peacekeeping operations.
Regarding its scope, this Law regulates the principles, subjects, forms, and fields; the building and deployment of forces; the provision of resources, regimes, and policies; international cooperation in United Nations peacekeeping; and the responsibilities of agencies and organizations in participating in United Nations peacekeeping forces.
The subjects to which the Law applies include: Officers, professional soldiers, defense workers and civil servants, non-commissioned officers, soldiers and units under the Ministry of National Defense; officers, non-commissioned officers, technical specialists, police workers, soldiers and units under the Ministry of Public Security assigned to participate in United Nations peacekeeping forces; State officials, civil servants and public employees assigned to participate in United Nations peacekeeping forces; agencies, units, organizations and individuals related to participation in United Nations peacekeeping forces.
Presenting the preliminary review report, the Chairman of the Committee on National Defense, Security and Foreign Affairs, Lieutenant General Le Tan Toi, stated that the Standing Committee on National Defense, Security and Foreign Affairs basically agreed on the necessity of enacting the Law on Participation in United Nations Peacekeeping Forces for the reasons stated by the Government in the Submission.
Regarding the scope of application, the Standing Committee agreed to add "state officials, civil servants, and public employees" participating in United Nations peacekeeping forces to Clause 2, Article 2 of the draft Law.
There are also opinions that Clause 2 of Article 2 of the draft new Law only stipulates that individuals are "state officials, civil servants, and public employees," and does not yet include provisions for units outside the armed forces. Some opinions suggest merging Clauses 1 and 2 into one clause and shortening it; others suggest removing Article 2 altogether.
Therefore, it is suggested that the drafting agency conduct a review and further clarify the reasons for not yet including regulations for units under ministries, departments, and localities; and at the same time, study the above opinions to ensure consistency, uniformity, and feasibility in the provisions of the Law.
Concluding this discussion, Deputy Speaker of the National Assembly Tran Quang Phuong stated that the Standing Committee of the National Assembly highly appreciated the Government and the Ministry of National Defense's active efforts in developing the draft Law; and the thorough and timely preparation of the dossier. The Standing Committee of the National Assembly also basically agreed with many contents in the draft Law and found that the draft Law is ready to be submitted to the National Assembly for consideration at the 9th Session.
To finalize the draft Law, the Vice Chairman of the National Assembly suggested further research and review of domestic legal regulations, relevant international treaties, and general United Nations regulations on participation in peacekeeping operations. He also requested a thorough review of the scope of the draft Law in cases where there are no existing legal provisions and where regulations currently apply to officers, armed forces personnel, and civilian officials, to ensure comprehensive and appropriate provisions.
