Proposed new regulations on leadership position allowances, expected to be applied from January 1, 2026

The Ministry of Home Affairs proposed to review and abolish regulations on allowances for leadership positions for general departments, district levels, and inspectorates due to the end of operations. At the same time, amend and supplement the allowances for leadership positions for the Department; amend the allowances for leadership positions at the commune level to match the new scale and tasks.

The Ministry of Home Affairs has drafted a Decree amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces (hereinafter referred to as the draft Decree). The document is being appraised by the Ministry of Justice .

It is necessary to perfect regulations on leadership position allowances.

The Ministry of Home Affairs said that, based on the Resolution of the 13th National Party Congress, the Conclusions of the Politburo and the Secretariat on the arrangement and streamlining of the apparatus of agencies and units in the political system, the arrangement of administrative units and the construction of a 2-level local government organization model, Regulation No. 368-QD/TW dated September 8, 2025 and Conclusion No. 206-KL/TW dated November 10, 2025 of the Politburo directing the adjustment of a number of allowance regimes from January 1, 2026, the completion of regulations on leadership position allowances is necessary and urgent, in order to ensure consistency with the Party's policies, in accordance with the new organizational model, contributing to improving the effectiveness and efficiency of state management and the quality of service to the people.

Accordingly, the Ministry of Home Affairs proposed to review and abolish regulations on leadership allowances for the General Department, district level, and Inspectorate (district inspectorate, Department inspectorate) due to the end of operations; amend and supplement the leadership allowances for the Department (the Department has 2 types: type 1 and type 2); amend the leadership allowances for the commune level to match the new scale and tasks.

New regulations on leadership position allowances expected to apply from January 1, 2026

Draft Decree regulating leadership allowances for new leadership positions or leadership positions that have changed or adjusted during the process of reorganizing the apparatus and administrative units under the State management of the Government. The document is expected to take effect from January 1, 2026.

The Draft Decree has the following basic contents.

Firstly, amend and supplement the regulations on leadership position allowances for Departments under the Ministry, and abolish the regulations on leadership position allowances for Departments under the General Department.

Pursuant to Regulation No. 368-QD/TW of the Politburo, Conclusion No. 206-KL/TW dated November 10, 2025 of the Politburo and Decree No. 303/2025/ND-CP of the Government, it is necessary to abolish the regulations on leadership position allowances of Departments under the General Department and amend and supplement the regulations on leadership position allowances of Departments under the Ministry (Type 1 Departments and Type 2 Departments) as follows:

First of all, for the Type 2 Department, the draft Decree maintains the regulations on leadership position allowances for Departments under the Ministry in Decree No. 204/2004/ND-CP.

Next, for the Type 1 Department, the draft Decree stipulates that the leadership position allowance for the positions of Department Director, Deputy Department Director, Department Head, and Deputy Department Head is 0.10 higher than the corresponding positions of the Type 2 Department, specifically: Department Director: 1.10; Deputy Department Director: 0.9; Department Head: 0.7, Deputy Department Head: 0.5.

The draft supplements the leadership position allowance for leadership positions of regional agencies and branches with the principle that the leadership position allowance coefficient of the Head of Department is equal to that of the Head of Regional Agency and the Branch Head (coefficient is 0.7) because currently some regional agencies under the Department of the Ministry are also branches (Customs Branch, State Reserve Branch...), at the same time to facilitate the mobilization and rotation of cadres from regions and branches to the staff departments under the Department.

Draft to supplement leadership position allowances for leadership positions of the Department according to the provisions of Decree No. 303/2025/ND-CP, including departments under the Department and teams under the Department: Head level: 0.3, deputy level: 0.2 (equal to the department level of the public service unit under the Department).

Second, amend and supplement the regulations on leadership position allowances for commune-level leadership positions (Clause 2, Article 1 of the draft Decree)

Pursuant to the List of positions, groups of positions, and leadership positions of the political system prescribed in Regulation No. 368-QD/TW of the Politburo, the drafting agency stipulates two levels for each position: communes, wards, and special zones in Hanoi and Ho Chi Minh City and the remaining communes, wards, and special zones; at the same time, based on the opinion of the Politburo in Conclusion No. 206-KL/TW dated November 10, 2025 on commune-level leadership position allowances, the draft Decree stipulates that the new commune-level leadership position allowance level is 0.05-0.1 lower than the old district level.

This plan ensures proper implementation of the Politburo's direction; is suitable and corresponds to the functions, tasks and authority of the commune-level administrative agencies and units after reorganizing the apparatus and implementing a two-level local government, avoiding the understanding that "the commune level is a miniature district level", specifically as follows:

Third, amend the regulations on position allowances of inspection agencies.

Pursuant to Article 7 of the 2025 Law on Inspection and Decree No. 303/2025/ND-CP regulating the State Bank Inspectorate (Inspectorship of ministerial-level agencies), Inspectorate of Ministries, Inspectorate of Departments of Ministries, amend the position allowance for leaders of the inspection sector in Decree No. 204/2004/ND-CP as follows:

- Abolish regulations on Inspectorates of Government agencies, General Departments, Grade I, II, III Departments, Departments under General Departments; at the same time, re-regulate leadership position allowances of Inspectorates of Departments under Ministries to comply with the 2025 Inspection Law and Decree No. 303/2025/ND-CP in the direction of being equivalent to the position of department-level leaders of Departments under Ministries.

- Abolish regulations on Department Inspectorate and District Inspectorate.

Fourth, abolish the regulation on leadership position allowances for organizations from General Department to Department and equivalent (Execution agencies, General Department of Customs, General Department of Taxation and State Treasuries at provincial level or lower under the State Treasury, Branches under the National Reserve Department)

The leadership allowance of an organization arranged from a General Department to a Department or equivalent is implemented according to the regulations on leadership allowance of the Department under the Ministry in the draft Decree.

Fifth, on enforcement.

The Decree is expected to take effect from January 1, 2026, in accordance with Conclusion No. 206-KL/TW of the Politburo. Unsuitable provisions in relevant legal documents are abolished.

The Draft Decree specifies the implementation of allowances for leadership positions of People's Committees at the commune level from July 1, 2025 to before January 1, 2026 and allowances for leadership positions of Departments under the Ministry from March 1, 2025 to before the date of the decision to classify the Departments.
