
At approximately 11:50 AM on December 25, 2024, Mr. Pham Anh Vuong (born in 1988, residing in Gia Lam, Hanoi ) was driving a car with license plate 30G-095.xx on Vo Chi Cong Street. Passing by a traffic accident, he noticed an unconscious woman on the road. Without hesitation, he ran a red light and, along with traffic police, arrived at the scene to take the victim to the hospital for emergency treatment.
This caused the city's traffic violation system to record the violation and add the vehicle to the list of offenders. When he checked the information before the Lunar New Year, he discovered the incident and proactively contacted the Hanoi Traffic Police Department to report it.
After receiving the complaint, the Traffic Police Department verified the entire process, clarifying the violation in the special circumstances. The results determined that Mr. Vuong committed the violation in an emergency situation to save a life, falling under the category of cases not subject to penalties (according to Article 11 of the Law on Handling Administrative Violations). Therefore, the traffic violation notice was removed, ensuring the legitimate rights of the citizen.
The above incident clearly demonstrates that law enforcement should not be rigid, but should take into account practical realities and protect the rights of those who act correctly. According to the law, administrative violations committed in emergency situations, such as protecting human life and health, will not be punished. This not only ensures fairness in the application of the law but also encourages a sense of responsibility among road users.
