Instructions for inspection and supervision of the election of deputies to the 16th National Assembly and People's Councils at all levels

Subjects, contents of inspection and supervision

According to the Notice, the inspection subjects at the Central level are the Standing Committee of the Central Committee of the Vietnam Fatherland Front inspecting the election work of the Vietnam Fatherland Front Committees of provinces and cities (generally referred to as provincial level); the Vietnam Fatherland Front Committees of communes, wards, and special zones (generally referred to as commune level) and the Front Work Committees in residential areas. At the local level, the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level inspects the election work of the Vietnam Fatherland Front Committees at the commune level and the Front Work Committees in residential areas; the Standing Committee of the Vietnam Fatherland Front Committee at the commune level inspects the election work of the Front Work Committees in residential areas.

The central supervisory subjects, the Standing Committee of the Central Committee of the Vietnam Fatherland Front supervises the election work for the National Election Council, the National Assembly Standing Committee, the Government , local election organizations; the Standing Committees of the People's Councils, People's Committees at all levels and relevant agencies, organizations and individuals.

At the local level, the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level supervises the election work for organizations in charge of elections, the Standing Committee of the People's Council, the People's Committee at the same level; organizations in charge of elections, the Standing Committee of the People's Council, the People's Committee at the commune level and relevant agencies, organizations and individuals. The Standing Committee of the Vietnam Fatherland Front Committee at the commune level supervises the election work for organizations in charge of elections, the Standing Committee of the People's Council, the People's Committee at the same level and relevant agencies, organizations and individuals.

The inspection and supervision contents focus on supervising the establishment and operation of the National Election Council and local election organizations. The Standing Committee of the Central Committee of the Vietnam Fatherland Front supervises the establishment and operation of the National Election Council and local election organizations. The Standing Committees of the Vietnam Fatherland Front Committees at all levels supervise the establishment and operation of local election organizations according to the provisions from Articles 12 to 28 of the Election Law. In particular, focusing on a number of contents: Structure, composition, number of members of the Election Team, Election Committee, Election Committee, National Election Council (stipulated in Articles 12, 22, 24, 25 of the Election Law); the issuance of documents related to election work; the performance of tasks and powers of local election organizations. Difficulties, obstacles and solutions as prescribed in Articles 23, 24 and 25 of the Law on Election.

Implementation period is from June 25, 2025 until the end of the tasks of the National Election Council and local election organizations.

Check the organization of consultative conferences

Regarding the inspection of the organization of consultation conferences, the Standing Committees of the Vietnam Fatherland Front Committees at all levels shall inspect the consultation and agreement on the structure, composition, and number of candidates for National Assembly deputies and People's Council deputies according to the provisions of the Election Law and Joint Resolution No. 102 dated September 26, 2025 of the National Assembly Standing Committee, the Government, and the Presidium of the Central Committee of the Vietnam Fatherland Front. In particular, focusing on a number of contents: ensuring the standards, structure, composition, and number of people of central and local agencies and units recommended for candidacy, candidates for National Assembly deputies and People's Council deputies according to regulations; ensuring the regulations on the balance of candidates, the proportion of candidates who are ethnic minorities and women according to the provisions of Articles 8 and 9 of the Election Law; ensuring the time, process, content, and procedures for organizing consultation conferences according to regulations.

Implementation period: The first consultation conference will take place from December 1 to 10, 2025. The second consultation conference will take place from February 2 to 3, 2026. The third consultation conference will take place from February 9 to 20, 2026.

Check and supervise the introduction of candidates for National Assembly and People's Council deputies

Regarding the inspection and supervision of the nomination of candidates for National Assembly deputies and People's Council deputies and the submission of candidacy dossiers of candidates and nominated candidates, the Standing Committees of the Vietnam Fatherland Front Committees at all levels shall inspect and supervise the nomination and nomination of candidates for National Assembly deputies and People's Council deputies according to the provisions of the Law on Election; Resolution No. 101 dated September 26, 2025 of the Standing Committee of the National Assembly detailing and guiding the organization of voters' conferences; the nomination of candidates for People's Council deputies at the commune level in villages and residential groups; the consultation, nomination of candidates, and the preparation of lists of candidates for National Assembly deputies and People's Council deputies in by-elections and guiding documents of the National Election Council.

In particular, focusing on some contents on the criteria of candidates as prescribed in Article 3 of the Law on Election; the leadership and command of the unit planning candidates to be introduced based on the number of candidates recommended by the agency, organization, or unit as prescribed in the Law on Election; the organization of conferences to collect opinions and comments from voters at the workplace of candidates recommended by the agency, organization, or unit as prescribed in the Law on Election; the number of candidates recommended and self-nominated compared to the number of elected delegates; the guidance on procedures for completing the list of documents as prescribed, the deadline for submitting documents for self-nominated candidates (as prescribed in Article 35 of the Law on Election and guiding documents of the National Election Council); the transfer of documents of candidates recommended and self-nominated within the time limit prescribed by law as prescribed in Article 36 of the Law on Election.

Implementation period is from December 17, 2025 to 5:00 p.m. February 1, 2026.

Check and supervise the organization of collecting opinions from voters at the place of residence for candidates

The Standing Committees of the Vietnam Fatherland Front Committees at all levels shall inspect the organization of collecting opinions from voters at the place of residence for candidates according to the provisions of the Election Law and Resolution No. 101 dated September 26, 2025 of the National Assembly Standing Committee. In particular, focusing on a number of contents: composition, number of voters, agenda of the voters' conference; special cases that do not gain the trust of more than 50% of the total number of voters attending the voters' conference at the place of residence must be clearly reported for the consultation conference to consider and decide on the candidates; the minutes of the voters' conference must clearly state the composition, number of participants, the progress and results of the conference; the verification and response to issues raised by voters regarding the nominated candidates and self-nominated candidates; ensuring voters participate substantially, democratically and equally.

Implementation period is from February 4 to 8, 2026.

Supervise the preparation and posting of voter lists

The Standing Committees of the Vietnam Fatherland Front Committees at all levels supervise the preparation of the voter list in accordance with the provisions of the Election Law. In particular, they focus on a number of contents: age calculation; voter qualifications and registration of voters on the list; people whose names are not registered, whose names are removed or whose names are added to the voter list; the posting and posting places of the voter list; and the settlement of complaints about the voter list.

Implementation period is from February 3 - March 15, 2026.

Supervise the preparation and posting of the list of candidates

The Standing Committees of the Vietnam Fatherland Front Committees at all levels supervise the preparation and posting of lists of candidates according to the provisions of the Election Law. In particular, focusing on a number of contents: Regarding the time of announcement, preparation of lists, and posting of lists of candidates for National Assembly deputies and People's Council deputies at all levels: ensuring that the official list of candidates posted is the list of qualified candidates after the third consultation conference transferred by the Standing Committees of the Vietnam Fatherland Front Committees at all levels; ensuring the balance of candidates; ensuring that during the time the National Election Council and the Election Committees at all levels have not yet announced the official list, if a candidate is prosecuted, arrested, detained for committing a crime in flagrante delicto, loses civil capacity, dies or seriously violates the law on elections, there must be a request from the Standing Committee of the Vietnam Fatherland Front Committee at the same level to remove that person's name from the official list; ensure that by the time voting begins, any person whose name is on the official list of announced candidates who is prosecuted, arrested, detained for flagrant offense, loses civil capacity, dies, or seriously violates election laws must have his or her name removed from the list of candidates; the settlement of complaints and denunciations about candidates and the establishment of the list of candidates by competent authorities.

Implementation period is from February 22 to March 15, 2026.

Check and supervise election propaganda and campaigning

The Standing Committees of the Vietnam Fatherland Front Committees at all levels inspect and supervise the propaganda and election campaigning according to the provisions of the Election Law. In particular, focusing on a number of contents: Responsibilities of mass media agencies where election campaigns take place; responsibilities of agencies, organizations and units with candidates campaigning for elections: ensuring the correct principles, time and form of election campaigns for candidates; responsibilities of candidates; prohibited acts in election campaigns; propaganda of election work at central and local levels; ensuring fairness, equality, democracy and objectivity in election campaigns; inspecting election campaigns through voter contact conferences according to the provisions of the Election Law; presiding agencies, composition and number of voters attending the conference; arrangement and arrangement of venues for voter contact conferences; ensuring the contents of the voter contact conference program; ensure fairness in the number of voter contact conferences between candidates.

Monitor election campaigns through mass media regarding the responsibilities of agencies in posting election campaign content and action programs of candidates; ensure fairness in the number of interviews and posting of action programs among candidates.

Implementation time: Election propaganda work from the time of deployment, election organization until the end of the election. Election campaign work during the period from February 27 to 7:00 a.m. on March 14, 2026.

Supervision of voting procedures and vote counting

The Standing Committees of the Vietnam Fatherland Front Committees at all levels supervise the voting process; voting procedures on election day; and vote counting according to the provisions of Articles 69 to 76 of the Law on Elections and the guiding documents of the National Election Council. In particular, focusing on a number of contents: Voter cards; arrangement of polling stations, locations, distances between the ballot receiving place, ballot-cutting booth, and ballot boxes; starting and ending times of voting; compliance with the principles of universal, equal, direct and secret ballot, ensuring that there are no cases of voting on behalf of others; stamping "Voted" by the Election Team on voter cards for voters who have voted; sealing of ballot boxes; vote counting; ensuring regulations on witnessing the vote counting and complaints about the vote counting; recording of the vote counting results; ensuring security and order in the election area.

Implementation time is from 5:00 to 21:00 on March 15, 2026.

Check and supervise the reception, processing and settlement of complaints, denunciations, recommendations and reflections related to election work.

Supervise the reception, handling and settlement of complaints, denunciations, recommendations and reflections related to the organization and operation of the National Election Council and local election organizations, related to nominated candidates, self-nominated candidates, candidates for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term for the National Election Council, the Standing Committee of the People's Council, the People's Committee and election organizations at all levels. Inspect the reception, handling and settlement of complaints, denunciations, recommendations and reflections related to the election of deputies to the 16th National Assembly and People's Councils at all levels for the 2026-2031 term for the Standing Committee of the Vietnam Fatherland Front at all levels.

Implementation period from the date of establishment of the National Election Council (June 25, 2025) to the end date of the election.

Forms of inspection and supervision:

Direct supervision: The Standing Committees of the Vietnam Fatherland Front at all levels directly supervise through: participation in election organizations at all levels; organization of consultation conferences to introduce candidates for National Assembly deputies and People's Council deputies at all levels; organization of voter conferences at the workplace and residence of candidates; organization of voter contact conferences for candidates for National Assembly deputies and People's Council deputies to campaign for elections. Through citizen reception, receiving and handling complaints, denunciations, petitions, and reflections from the people and reflections on the mass media.

Coordination of inspection and supervision: The Standing Committees of the Vietnam Fatherland Front at all levels send representatives to participate in coordinating the inspection and supervision of election work when competent agencies and organizations organize inspection and supervision teams. Organizing inspection and supervision teams; The Standing Committees of the Vietnam Fatherland Front at all levels preside over the organization of inspection and supervision teams for election work in the locality. The process of implementing supervision by teams is implemented according to Joint Resolution No. 403; Circular No. 23 dated July 21, 2017 of the Standing Committee of the Central Committee of the Vietnam Fatherland Front guiding the supervision process and the social criticism process of the Vietnam Fatherland Front.

In particular, pay attention to some contents: Issue a decision to establish an inspection and supervision team including: Head of the team; team members; select locations for inspection and supervision. The Standing Committee of the Vietnam Fatherland Front Committee at all levels establishes inspection and supervision teams for the election work in 100% of localities holding re-elections and supplementary elections (if any). The inspection and supervision team works with the supervised subjects in the form of organizing a supervision team. In case no supervision team is organized, supervision is carried out in the form of research and review of reports.

During the implementation process, if any illegal acts or violations are discovered, the Vietnam Fatherland Front Committees at all levels must promptly inform, reflect and make recommendations to competent authorities for consideration, resolution and immediate remediation. Do not arbitrarily handle issues that are not within the authority and function of the Vietnam Fatherland Front at all levels. Avoid duplication and overlap in locations in inspection and supervision activities between levels of the Vietnam Fatherland Front and with other agencies and organizations, causing difficulties for localities and units being supervised.

At the end of the election, the Standing Committees of the Vietnam Fatherland Front Committees of provinces and cities, socio-political organizations and member organizations synthesize reports on the situation and results of inspection and supervision activities of the election of deputies to the 16th National Assembly and People's Council deputies at all levels for the 2026-2031 term at all levels in the locality and send them to the Standing Committee of the Central Committee of the Vietnam Fatherland Front (before March 20, 2026).
