Politico reported that California Attorney General Rob Bonta announced on December 12 that California and 19 other US states have filed a lawsuit against the Trump administration over its policy of increasing the fee to $100,000 for new H-1B visa applications for skilled foreign workers.
Mr. Bonta argued that increasing visa fees for skilled workers is illegal because it exceeds the amount authorized by Congress and undermines the original purpose of the program.
“No presidential administration can rewrite immigration law. No president can ignore Congress, the Constitution, or the law,” Bonta said at a press conference in San Francisco.
Mr. Bonta further argued that this visa fee increase would also exacerbate labor shortages in other sectors vital to the state economy by making it more difficult to recruit doctors, researchers, teachers, nurses, and public service workers.
Meanwhile, White House spokesman Taylor Rogers defended the administration's actions on December 12, arguing that the visa fee increase was not only legal but also "a necessary, initial, and incremental step toward necessary reforms to the H-1B program."
“President Trump promised to put American workers first, and his sensible action on the H-1B visa fulfilled that promise by preventing companies from abusing the system and undercutting American wages, while providing certainty for employers who need to attract the best talent from overseas,” said Taylor Rogers.
