Regulations and policies for senior experts

The Government has just issued Decree No. 92/2025/ND-CP dated April 25, 2025 stipulating the regime and policies for senior experts.

Many benefits and policies for senior experts.

The Decree stipulates the regime and policies for senior experts; guides the use of senior experts who are foreigners and overseas Vietnamese in central Party and State agencies, including: Central Organization Committee; Central Propaganda and Mass Mobilization Committee; Central Internal Affairs Committee; Central Policy and Strategy Committee; Central Inspection Commission; Central Party Office; Office of the President; Government Office ; Office of the National Assembly.

Applicable objects

A senior expert is a person who meets the standards and conditions appointed by a competent authority according to Regulation No. 180-QD/TW of 2024 of the Secretariat on senior experts, including:

1- Cadres, civil servants, public employees.

2- Retired people, people working outside the political system (people not on the payroll of agencies and organizations in the political system, including both Vietnamese and foreigners).

Regime and policies for senior experts who are cadres, civil servants and public employees

The Decree stipulates that senior experts are cadres, civil servants, and public employees holding leadership and management positions, receiving salaries according to the civil servant rank, professional title, and receiving leadership position allowances, or those not holding leadership and management positions who are appointed as senior experts shall cease to hold their previous job positions from the date of appointment as senior experts, and shall be paid according to the senior expert salary table issued together with Decree No. 204/2004/ND-CP of the Government on salary regimes for cadres, civil servants, public employees, and armed forces (abbreviated as Senior Expert Salary Table) and enjoy the following regimes and policies:

1- In case of holding a leadership or management position with a position allowance coefficient of 0.9 or less or not holding a leadership or management position, the following regimes and policies are enjoyed:

a) Salary is ranked at level 1, salary coefficient 8.80 of the Senior Expert Salary Table.

b) Enjoy benefits and policies related to public service activities equivalent to the title of Assistant to senior leaders of the Party and State.

2- In case of holding a leadership or management position with a position allowance coefficient from 1.0 to 1.25, the employee is entitled to the following regimes and policies:

a) Salary is ranked at level 2, salary coefficient 9.40 of the Senior Expert Salary Table.

b) Enjoy benefits and policies related to public service activities equivalent to the position of Deputy Minister.

3- In case of holding a leadership or management position with a position allowance coefficient of 1.30 or higher, the employee is entitled to the following regimes and policies: (*)

a) Salary is ranked at level 3, salary coefficient 10.0 of the Senior Expert Salary Table.

b) Enjoying benefits and policies related to public service activities equivalent to the title of Minister.

4- In case the new salary coefficient is lower than the total old salary coefficient (including salary coefficient according to rank, level, title plus leadership position allowance and seniority allowance exceeding the framework, if any), the difference coefficient will be retained equal to the total old salary coefficient.

5- The agency employing senior experts, based on the work efficiency of the senior experts and the agency's resource capacity, can implement a number of other policies and regimes (bonuses, working conditions...) suitable to the actual situation of the agency.

6- In case after ceasing to be a senior expert, the competent management authority appoints the cadre, civil servant or public employee to a new job position, the salary level in the civil servant rank, the professional title the civil servant enjoyed before appointing the senior expert and the time working as a senior expert will be ranked to a higher salary level in that civil servant rank, professional title of the civil servant; the employee will be entitled to salary allowances (if any) associated with the new job position according to regulations.

Regime and policies for senior experts who are retired and work outside the political system

According to the Decree, the head of the agency shall negotiate with the person expected to be selected and appointed as a senior expert on the salary level and regime and policies depending on each specific case within the scope of the regime and policies for senior experts who are cadres, civil servants and public employees, up to the maximum level specified in (*) above before submitting to the competent authority for appointment as a senior expert as a basis for signing a work contract.

Agencies employing senior experts for foreigners and overseas Vietnamese must ensure compliance with the provisions of the law on labor, state secrets, relevant laws and the working regulations of the agency.

The Decree takes effect from June 15, 2025.
