Subjects of application and scope of regulation
Circular 56/2025/TT-BCT of the Ministry of Industry and Trade stipulates the specialized inspection process for the Industry and Trade sector as prescribed in point b, clause 2, Article 18 of Decree No. 217/2025/ND-CP.
This Circular does not regulate the inspection of the organization and implementation of laws; the inspection and handling of administrative violations by market management forces under the Ordinance on Market Management; the inspection of the implementation of laws on handling administrative violations; the inspection of the origin of goods under the Law on Foreign Trade Management; inspections serving the process of resolving administrative procedures; and other inspection activities as prescribed by laws, resolutions of the National Assembly , ordinances, and resolutions of the Standing Committee of the National Assembly.

The subjects of application are: State management agencies in the Industry and Trade sector; Heads of state management agencies in the Industry and Trade sector; agencies and units delegated or authorized to conduct specialized inspections in the Industry and Trade sector; Heads and members of specialized inspection teams in the Industry and Trade sector; agencies, organizations, units, and individuals subject to specialized inspections in the Industry and Trade sector; and other related agencies, organizations, units, and individuals.
Authority and content of inspection
According to the Circular, the authority for specialized inspections is clearly defined; the Minister of Industry and Trade has the authority to conduct specialized inspections within the scope of the Ministry of Industry and Trade's state management.
The Chairman of the National Competition Commission and the Directors of Departments under the Ministry of Industry and Trade have the authority to conduct specialized inspections of organizations and individuals within their delegated or authorized scope.
The authority to inspect the specialized industry and trade at the local level is implemented according to Clause 2, Article 6 of Decree No. 217/2025/ND-CP.
The specialized inspections in the field of Industry and Trade cover over 15 groups of areas. For the field of industrial technical safety and environment, inspections focus on compliance with laws on occupational safety and hygiene; electrical safety, dam and hydroelectric reservoir safety; technical inspection; incident response; and transportation of hazardous goods.
In the industrial sector, inspections cover mechanical engineering, metallurgy, mining and mineral processing, consumer goods, food, supporting industries, high technology, industrial promotion activities, and industrial clusters.
In the energy sector, the scope of inspection spans from power planning, electricity markets, and power system operation, to coal, oil and gas, petroleum, and liquefied petroleum gas (LPG) operations. This is considered the most complex group of sectors, closely linked to national energy security.
In addition, commercial sectors including import and export, logistics, trade promotion, trade infrastructure, commodity trading through exchanges, e-commerce, competition, consumer protection, and multi-level marketing are all included in the list of specialized inspections.
