The Standing Committee of the Hanoi People's Council periodically receives citizens

The citizen reception was chaired by Standing Member of the City People's Council, Head of the Legal Committee of the City People's Council Duy Hoang Duong.

The case was about Ms. Hoang Thi Phuong and her husband Mr. Pham Thanh Binh, living in group 9, Dong Anh railway station, Thu Lam commune, Hanoi, requesting to issue a land use right certificate for their household in Kinh No village, Uy No commune, old Dong Anh district - now Thu Lam commune.

The process of handling the application is as follows: Ms. Hoang Thi Phuong's family uses land plot No. 41, map sheet No. 43, area ^108m2 in Kinh No village, Uy No commune, Dong Anh district; was granted a land use right certificate by the People's Committee of Dong Anh district on October 25, 2004.

In Decision No. 3875/QD-UBND dated June 8, 2005 of the Hanoi People's Committee, Factory Z153/General Department of Engineering (now the General Department of Logistics - Engineering) was granted Land Use Right Certificate No. AB 082505 with the following content: Factory Z153/General Department of Engineering/ Ministry of National Defense is entitled to use 241,715 m² of land in Uy No commune, Dong Anh district. Of which, 288.5 m² of land area is the overlapping area on paper for 3 households.

On June 23, 2008, the Department of Natural Resources and Environment of Dong Anh district issued Notice No. 44/TB-TNMT on revoking the land use right certificate of Ms. Hoang Thi Phuong's household, due to "incorrect shape, size, and area of the land plot". However, Ms. Hoang Thi Phuong's household has built a solid house and is living stably on the land.

On June 18, 2020, the City People's Committee issued Document No. 5034/VP-DT assigning the Director of the Department of Natural Resources and Environment to preside over and coordinate with the Chairman of the People's Committee of Dong Anh district to inspect and resolve citizens' petitions regarding the City People's Committee's issuance of a land use right certificate to Factory Z153 in 2005, which overlapped with the land area of Ms. Hoang Thi Phuong's household, which had been granted a land use right certificate.

On July 29, 2020, the Ministry of National Defense issued Document No. 2680/BQP-TM to the City People's Committee regarding the handover of land from the General Department of Engineering to the Hanoi People's Committee for management, including the following content: agreeing to allow the General Department of Engineering to hand over 288.5 ^{square meters} of defense land in Uy No commune, Dong Anh district (managed by Factory Z153) to the Hanoi People's Committee for management and use;

The Ministry of National Defense assigned the General Department of Technology to work with the Hanoi People's Committee to resolve related issues and complete procedures for handing over land to local management and include the above land area in the adjustment of the Land Use Planning for national defense purposes in the next period of 2021-2030 in Hanoi according to the provisions of law.

By December 31, 2024, the People's Committee of Dong Anh district had sent a report to the City People's Committee and the Department of Natural Resources and Environment on difficulties and problems in granting land use right certificates to households and individuals in Kinh No village, Uy No commune, Dong Anh district due to overlapping with the land area of Factory Z153.

The People's Committee of the old Dong Anh district has proposed that the City People's Committee and the Department of Natural Resources and Environment soon provide guidance to Factory Z153 to complete the procedures for changes in the land use right certificate. However, up to now, after 17 years, citizens have not yet been granted certificates of land use rights, house ownership rights and other assets attached to the land plot in Uy No commune, Dong Anh district.

Upon receiving the petition, the Standing Committee of the City People's Council has forwarded the petition No. 42/PCĐ-HĐND dated June 2, 2025 and the urging dispatch No. 270/HĐND-VP dated August 12, 2025 to the Chairman of the City People's Committee for direction and resolution. The Office of the City People's Committee has issued a document urging the Department of Agriculture and Environment to resolve the citizen's petition.

The Department of Agriculture and Environment has issued an official dispatch requesting Factory Z153/General Department of Logistics - Engineering/Ministry of National Defense to review and declare the current status of land use and prepare and complete the dossier to revoke the Certificates that were issued in violation of the provisions of the land law discovered by land users and owners of assets attached to the land and reissue the Certificates after revocation. At the same time, the People's Committee of Thu Lam commune is requested to study the provisions of the land law to promptly resolve the issuance of Certificates to households and individuals using land according to their authority and provisions of the law.

After listening to citizens' opinions and the progress of the departments, branches and units, Head of the Legal Committee - City People's Council Duy Hoang Duong requested the Department of Agriculture and Environment to continue reviewing and by November 2025, must have a document urging for early resolution for citizens; direct the People's Committee of Thu Lam commune to completely resolve the issue of granting land use right certificates to Ms. Nguyen Thi Phuong's household; report the resolution results to the Standing Committee of the City People's Council.
