With this decision, Judge Mercy rejected Trump's request that the trial be dismissed after his election as president on November 5, 2024, Reuters reported on January 4.
Before his inauguration, President-elect Trump must hear his sentencing.
Judge Mercyn said Trump could either come to court or attend the sentencing hearing on January 10 remotely.

Judge Merchuan also stated that the "most feasible solution" in this case is to sentence the defendant but "release him unconditionally," meaning no detention, fines, or probation.
Mr. Trump is also expected to appeal.
Following the news of the subpoena, Trump's spokesperson, Steven Cheung, stated that no conviction should have been issued, and that the U.S. Constitution stipulates that the case should be dismissed immediately.
