According to Minister Thang, the draft law is designed to institutionalize the policy of reorganizing the apparatus and local government at two levels; strengthening decentralization; focusing on removing "bottlenecks" to simplify administrative procedures, reduce investment and business conditions, and resolve urgent arising issues.
Increase decentralization in management
The draft Law amends and supplements 15 laws in the fields of agriculture and environment (excluding the Land Law, the Law on Geology and Minerals), including: Law on Environmental Protection; Law on Plant Protection and Quarantine; Law on Animal Husbandry; Law on Biodiversity; Law on Dikes; Law on Surveying and Mapping; Law on Hydrometeorology; Law on Forestry; Law on Natural Disaster Prevention and Control; Law on Water Resources; Law on Marine and Island Resources and Environment; Law on Veterinary Medicine; Law on Irrigation; Law on Fisheries; Law on Cultivation.
According to Minister Thang, there are three main groups of contents proposed in the draft law. These include the arrangement of the administrative apparatus, decentralization, and division of authority when organizing two-level local governments.
The Law will amend the contents related to changing the names of agencies after merging, separating, and defining the authority and specific tasks related to agencies and local government levels.
To implement the Party and Government 's policy on reforming, cutting down, and simplifying administrative procedures and business investment conditions, creating a favorable, healthy, and fair business environment, focusing on people and businesses and promoting innovation and creativity, the bill amends 75 articles, abolishing business investment conditions and related administrative procedures.
At the same time, the bill also amended 20 bottlenecks that need to be addressed to clear resources. In particular, the Veterinary Law will amend regulations on veterinary drug quality management measures in the direction of exempting conformity declaration.
The Law on Plant Protection and Quarantine amends the regulations prohibiting the import of soil and harmful organisms into Vietnam in the direction of allowing the import of soil-bearing plants that meet the requirements prescribed by the Government.
The Law on Cultivation will supplement regulations on assigning agencies to guide the issuance and management of packaging facilities to serve as a legal basis for stipulating documents guiding implementation; Abolish regulations on the topsoil layer of land specialized in growing wet rice to remove obstacles when implementing investment projects.
Eliminate regulations on standards and conditions for changing forest use purposes.
The Law on Animal Husbandry will remove the requirement to have "national technical regulations" on testing livestock breeds and lines, and animal feed (only need to have regulations on testing livestock breeds and lines, and animal feed).
The revised Forestry Law stipulates conditions for converting forest use to other purposes, temporary use of forests, authority to decide on conversion and cancellation of policies; regulations on replacement forest planting, forest environmental services, forest carbon absorption and storage...
The Law on Water Resources will amend regulations on the prohibition of "encroachment or filling in rivers, streams, canals, ditches, and streams, except in cases where otherwise provided by law"; the integration of irrigation planning into the overall planning of river basins; the authority to monitor water resources...
The Law on Dikes will amend and supplement regulations on dike protection corridors in the direction of clarifying "dike protection corridors" at locations where dikes pass through existing residential areas, urban areas and tourist areas" and clarifying protection corridors for sea dikes; handling existing works and houses within the dike protection area and on river banks, floating banks or islands.
The Law on Environmental Protection will amend regulations related to changing the purpose of using rice land from two crops, resettlement, environmental impact assessment, environmental protection technical infrastructure; imported scrap; Environmental Protection Fund...
The Law on Biodiversity will abolish regulations on the management of alien organisms to ensure consistency between regulations within the Law on Biodiversity.
