
The report presented by Minister of Science and Technology Nguyen Manh Hung clearly states that intellectual property (IP) is becoming a strategic tool for protecting and mastering technology, and a tool for technological competition. Models for buying, selling, transferring, licensing, intellectual property exchanges, IP valuation, and IP financing are increasingly developing. The development of digital technology , the digital environment, and new technologies poses new challenges to the protection of IP rights. International cooperation and competition for IP rights are driving the globalization of IP rights…
Meanwhile, Vietnam's goal is to become a digital nation by 2030, developing a digital government, digital economy , and digital society. Therefore, intellectual property law also needs to be improved to ensure the fulfillment of international commitments in the context of changing global trade practices.

Therefore, the law aims to create a solid and favorable legal framework for the protection of intellectual property rights, especially in certain areas where Vietnam has potential and advantages; to promote innovation and develop the intellectual property market; and to create a favorable environment for the acquisition, absorption, mastery, and application of advanced scientific and technological achievements.
Specifically, the draft adds regulations on handling conflicts of intellectual property rights to facilitate commercial exploitation; it also includes provisions on the State's policies to support the creation and commercial exploitation of intellectual property rights to promote innovation: the State prioritizes the purchase of important intellectual property rights related to national security and socio-economic development; it takes the lead in ordering, purchasing, and using products and services created based on the application of computer programs, inventions, layout designs, and plant varieties created in Vietnam; and it adds policies to develop the intellectual property ecosystem, encouraging organizations and individuals to invest in startup businesses.
The draft also adds provisions on finance based on intellectual property rights: encouraging the use of intellectual property rights to borrow capital or mortgage for loans in accordance with the laws on finance, banking, and related laws; allowing intellectual property rights owners to determine their own value and create a separate inventory for management in cases where the intellectual property rights do not yet meet the conditions for recording asset value in the accounting books… This aims to create a complete legal basis to promote the commercial exploitation of intellectual property rights, transforming them into commercially valuable assets that can be exploited and used like other tangible assets.
