Building the first land price list applicable from January 1, 2026: The increase roadmap is suitable for the actual situation

Up to now, the Department of Agriculture and Environment (DARD) has investigated, surveyed, drafted; synthesized comments from units, organizations, and people in the province and completed the draft Resolution of the Provincial People's Council on the first land price list applied from January 1, 2026 in the province.

Land price close to market

The 2024 Land Law, effective from August 1, 2024, has institutionalized the orientations in the documents of the 13th National Party Congress, resolutions of the Party and the National Assembly . One of the new contents of the 2024 Land Law is the completion of the mechanism for determining land prices according to market principles. The law has removed the Government's land price framework; the land price list is built periodically every year, made public and applied from January 1 of the year in accordance with the market mechanism.

According to the leader of the Department of Agriculture and Environment, the first land price list applied from January 1, 2026 in the province was built to ensure fairness between the State, land users and investors when performing financial obligations and administrative procedures on land; has a roadmap, is suitable for market mechanisms and closely follows the situation of local land price fluctuations.

The results of the analysis of information on tax declaration prices at tax offices in the whole province show that the declared prices shown through transfer contracts do not reflect the actual transaction value on the market. The investigation results show that the market land price is higher than the price specified in the current land price list of the province. The difference depends on each area, location, and route due to market fluctuations compared to the time of the approved land price list, or infrastructure and traffic have been invested and upgraded, urban areas, new residential areas, resettlement areas are relatively complete compared to other residential areas, or areas where market price fluctuations are controlled by the previous Government land price framework.

From the information survey data and the land use rights transfer situation collected by the consulting unit as mentioned above, the Department of Agriculture and Environment found that the adjustment of land prices in the land price list of the province in 2026 is not really necessary. The reason is that in 2025, the Provincial People's Committee adjusted the land price list of the province to reduce the gap between land prices in the land price list of the province and land prices traded on the market; in central wards such as Nha Trang, Phan Rang, Ninh Hoa, Cam Ranh..., the issuance of first-time land use right certificates and land use purpose changes for households, individuals, and land users in general have almost been completed and are not affected or impacted by the land price list. Therefore, the adjustment of land prices for land types in the land price list to be applied in the following years should be implemented according to a gradual increase schedule over the years from 2026 onwards to suit the actual situation in the locality.

Increase according to the roadmap each year

From the results of synthesizing common land transfer prices on the market in the 24-month period up to the time of constructing the land price list in March 2025; comparing land prices in the land price list regulated by the Provincial People's Committee with common land transfer prices on the market; the situation of applying the province's land price list from January 1, 2020 to present, the Department of Agriculture and Environment proposes a land price list plan applicable from January 1, 2026 in the following direction: Basically maintain the land price level stipulated in the province's 2025 land price list based on the results of the market land price survey by the above consulting unit; based on the average income per capita of the province in 2024 announced by the provincial statistical agency.

In particular, for residential land: The areas of the wards of North Nha Trang, South Nha Trang, West Nha Trang, Ninh Hoa, East Ninh Hoa, North Cam Ranh, Cam Ranh, Phan Rang, Do Vinh, Bao An, the communes of South Cam Ranh, Cam Lam, Dien Khanh, Van Ninh initially propose an increase of 5 to 10% compared to the 2025 land price list. The remaining communes and wards remain the same as the 2025 land price list. For residential land along the main traffic routes through the communes, rural residential land remains the same as the 2025 land price list; continue to research and adjust the land price to increase gradually according to the roadmap each year compared to the land price specified in the 2026 land price list to suit the actual local situation.

For non- agricultural production and business land, commercial service land, land in industrial parks and industrial clusters, it is proposed to keep the land price list unchanged in 2025 and gradually increase it according to the roadmap each year compared to the land price specified in the land price list in 2026. For agricultural land, keep the land price list unchanged in 2025; continue to gradually increase it according to the roadmap each year compared to the land price specified in the land price list in 2026.
