How are the 5 groups of people who quit their jobs due to organizational restructuring entitled to benefits?

(Dan Tri) - The Government has just issued Resolution No. 07 on policies and regimes for subjects affected by the implementation of organizational restructuring of administrative apparatus and units at all levels.

In this Resolution, the Government decides on policies for 5 groups of subjects:

1. For cadres, civil servants, public employees, workers and armed forces who are of retirement age: If they have a total compulsory social insurance payment period of 15 years or more while working in arduous, toxic, dangerous/especially arduous, toxic, dangerous occupations or jobs, they will be entitled to immediate pension.

These people are also entitled to a one-time allowance calculated based on their working time from the time they reach the prescribed retirement age. In case their working time is 15 months or less, they are entitled to a one-time allowance equal to 15 months of current salary.

In case of working period of 15 months or more, the employee will receive a one-time allowance equal to 15 months of current salary for the first 15 months of working; from the 16th month onwards, the allowance will be 0.5 months of current salary for each month. The maximum one-time allowance is not more than 24 months of current salary.

2. For cadres from commune level and above who have reached retirement age or are enjoying pension, disability benefits, or sick soldiers benefits and immediately quit their jobs due to organizational restructuring : They will receive a one-time allowance calculated based on the working time from the time they reach retirement age or from the time they enjoy pension, disability benefits, or sick soldiers benefits to the time they quit their jobs.

In case of working time of 15 months or less, the staff is entitled to a one-time allowance equal to 15 months of current salary.

If the working period is 15 months or more, the officer is entitled to a one-time allowance equal to 15 months of current salary for the first 15 months of work; from the 16th month onwards, each month the allowance is 0.5 months of current salary. The maximum one-time allowance is not more than 24 months of current salary.

3. For those working under labor contracts in public service units : The Government's Resolution clearly states that those whose age is lower than the retirement age are entitled to early retirement policy.

In case of reaching retirement age, they will enjoy the same policies and regimes as for cadres, civil servants, public employees, workers and armed forces as prescribed above.

4. People who work outside the staffing quota at Associations assigned by the Party and the State at the provincial or district level before July 1st and immediately quit their jobs due to the implementation of two-level local government include: full-time presidents and vice presidents of working age; full-time presidents and vice presidents who are retired and people of working age working under labor contracts.

The Government stated that these subjects are entitled to a one-time subsidy decided by the locality based on the balance of local budget sources, but not exceeding 24 months of current salary or remuneration; their social insurance payment period is reserved or they are entitled to a one-time social insurance payment and unemployment insurance according to regulations.

5. For full-time union officials working under labor contracts :

The Government Resolution clearly states that those under 2 years of age reaching retirement age will receive a one-time pension benefit equal to 0.8 months of current salary multiplied by the number of months of early retirement compared to the retirement date.

In case of meeting the working time requirement with compulsory social insurance payment to receive pension, they will enjoy retirement regime according to the provisions of law and will not have their pension rate deducted due to early retirement.

In case of having 2-5 years left until retirement age, the staff will receive a one-time pension allowance equal to 0.8 months of current salary multiplied by the number of months of early retirement compared to the retirement date.

If an officer meets the requirements for working time and has paid compulsory social insurance to receive a pension, in addition to receiving a pension, he/she will also receive a subsidy of 4 months of current salary for each year of early retirement; a subsidy of 3 months of current salary for the first 15 years of working with compulsory social insurance. From the 16th year onwards, for each year of working with compulsory social insurance, he/she will receive a subsidy of 0.5 months of current salary.

In case of having more than 5-10 years left until retirement age, cadres are entitled to a one-time pension allowance equal to 0.7 months of current salary multiplied by 60 months.

This Resolution comes into force from September 17, 2025.
