Ministry of Industry and Trade consolidates new regulations on tobacco business

The document is issued on the basis of consolidating Circular No. 57/2018 dated December 26, 2018, Circular No. 28/2019/TT-BCT dated November 15, 2019, Circular No. 53/2020/TT-BCT dated December 31, 2020, Circular No. 30/2022/TT-BCT dated November 4, 2022, Circular No. 43/2023/TT-BCT dated December 28, 2023, Circular No. 38/2025/TT-BCT dated June 19, 2025 of the Minister of Industry and Trade .

Scope of regulation includes application form, certificate form of eligibility to invest in tobacco growing, license form and list forms related to the issuance, supplementary issuance, amendment, re-issuance of certificates and licenses (certificate of eligibility to invest in tobacco growing, license to buy and sell tobacco materials, license to process tobacco materials, license to manufacture tobacco products, license to buy and sell tobacco products).

Instructions on the regime and forms for reporting the list of specialized tobacco equipment; instructions on the form for registering the need to import cigarette rolling paper, tobacco fibers, tobacco leaf materials and regulations on inspecting tobacco business activities.

The Circular applies to organizations and individuals trading in tobacco and other activities related to tobacco trading in Vietnam.

Regarding the import of tobacco materials and cigarette rolling paper, based on the annual tariff quota, the production output of the enterprise, the ability to meet domestic raw materials and the registration needs of the enterprise to produce tobacco products for domestic consumption, the provincial People's Committee will consider approving the enterprise to use tobacco materials and cigarette rolling paper for the right purpose without exchanging or selling in any form. The enterprise shall submit a registration dossier according to the form in Appendix No. 1 attached to this Circular.

Enterprises importing tobacco materials and cigarette rolling paper to produce tobacco products for export or process tobacco products for export must submit an application form according to Appendix No. 2 attached to this Circular to the Provincial People's Committee.

Enterprises importing tobacco materials to process tobacco materials for export or processing tobacco materials for export must submit an application form according to Appendix No. 3 attached to this Circular to the Provincial People's Committee.

In addition, the document also clearly stipulates the application form, list of requests for issuance of certificates, licenses and sample certificates, licenses; application form for issuance of amendments, supplements, re-issuance of certificates, licenses and sample forms for issuance of amendments, supplements, re-issuance of certificates and licenses; forms, reporting regime; regulations on inspection.

The Circular takes effect from February 19, 2019. The provisions on application forms, lists of applications for tobacco product manufacturing licenses and tobacco product manufacturing license forms of this Circular take effect from January 1, 2028.

Annul Circular No. 21/2013/TT-BCT dated September 25, 2013 detailing a number of articles of Decree No. 67/2013/ND-CP dated June 27, 2013 of the Government detailing a number of articles and measures to implement the Law on Prevention and Control of Tobacco Harms on tobacco trading from the effective date of this Circular.

In particular, the regulations on application forms, lists of applications for tobacco product manufacturing licenses and tobacco product manufacturing license forms of Circular No. 21/2013/TT-BCT will continue to apply until December 31, 2027.

In the process of implementation, if there are any problems, organizations and individuals need to promptly report to the Ministry of Industry and Trade for resolution and consideration of adjustments to the Circular according to authority.
