Officially abolish the regulation that each couple can only have one or two children

The National Assembly Standing Committee has decided to remove the regulation that each couple or individual can only have one or two children in the Population Ordinance.

On the afternoon of June 3, continuing the 46th session, the National Assembly Standing Committee passed the Ordinance amending Article 10 of the Population Ordinance No. 06/2003/PL-UBTVQH11, which was amended and supplemented by Ordinance No. 08/2008/PL-UBTVQH12.

Presenting the report, Minister of Health Dao Hong Lan said that the Government submitted to the National Assembly Standing Committee to amend Clause 1, Article 1 of the Population Ordinance No. 08/2008/PLUBTVQH12, amending Article 10 of the 2003 Population Ordinance: "Decision on time and spacing of births" to "Decision on time of birth, number of children and spacing between births appropriate to the age, health status, conditions of study, labor, work, income and child-rearing of individuals and couples on the basis of equality". At the same time, remove Clause 2: "Give birth to one or two children, except in special cases prescribed by the Government"; keep Clause 3 unchanged.

Article 10 of the 2003 Population Ordinance, amended in 2008, stipulates:

“Rights and obligations of each couple and individual in implementing the population and family planning campaign and reproductive health care:

1. Decide when and how far apart you want to have children;

2. Have one or two children, except in special cases prescribed by the Government;

3. Protect health, take measures to prevent reproductive tract infections, sexually transmitted diseases, HIV/AIDS and perform other obligations related to reproductive health".

This amendment aims to overcome the fertility gap between regions and groups, and avoid the fertility rate falling too low and not reaching the replacement level - which could negatively affect sustainable economic, social, security and defense development in the future.

Agreeing with the amendment of the Population Ordinance, Chairman of the National Assembly's Committee on Culture and Society Nguyen Dac Vinh said that this amendment is only a short-term solution. In order to comprehensively solve population issues and fulfill population goals and tasks, Mr. Nguyen Dac Vinh requested the drafting agency to promptly complete the draft dossier of the Population Law to fully institutionalize the Party's viewpoints and policies; ensure the quality and progress of drafting the Population Law to be submitted to the National Assembly Standing Committee and the National Assembly in accordance with the provisions of the Law on Promulgation of Legal Documents.

At the meeting, with 100% of members present in agreement, the National Assembly Standing Committee passed the Ordinance amending Article 10 of the Population Ordinance No. 06/2003/PL-UBTVQH11, which was amended and supplemented by Ordinance No. 08/2008/PL-UBTVQH12.
