Attending the meeting were comrade Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the Provincial National Assembly Delegation; representatives of the Office, Party Committees of the Provincial Party Committee, Provincial Fatherland Front Committee; leaders of departments, branches and Tan Ky district.

Chairman of Nghe An Provincial People's Committee Nguyen Duc Trung received citizen Nguyen Thi Sam, residing in Block 5, Tan Ky Town (Tan Ky District). Ms. Sam complained that Tan Ky District People's Committee did not issue a land use right certificate for plots 154 and 187, on map 15, Nghia Hoan Commune, Tan Ky District to her family according to regulations, affecting the family's legitimate rights and interests.

Ms. Sam said that the origin of these two plots of land was purchased by her family from 3 households in 1998 and 2000. Her family fulfilled their financial obligations and the purchase and sale was certified by Nghia Hoan commune. The land was used by the family for the purpose of producing construction materials from 1998 to 2017 after the State had a policy to eliminate manual tile kilns.
Reporting on the incident, Chairman of Nghia Hoan Commune People's Committee Nguyen Dinh Hung said that after receiving Ms. Sam's documents, the commune checked and verified the origin and land use process. This is 5% of the land managed by the Commune People's Committee, contracted to households to build manual tile kilns, and annually paid the communal land contract interest to the Commune People's Committee.

Vice Chairman of Tan Ky District People's Committee Pham Hong Son also said that Ms. Sam's application for a land use right certificate did not meet the requirements. This is 5% of the land managed by Nghia Hoan Commune, which is not in accordance with the land use planning because this is currently land for production and business, planned to build an industrial cluster of the district.

Deputy Director of Nghe An Department of Natural Resources and Environment Pham Van Toan said that the authority to issue the first Land Use Right Certificate belongs to the Chairman of the District People's Committee. Therefore, the Chairman of Tan Ky District People's Committee must have a final written response on whether Ms. Sam's application meets the conditions for granting a Land Use Right Certificate or not.

After listening to the opinions of the relevant parties and concluding the meeting, Chairman of the Provincial People's Committee Nguyen Duc Trung said that Ms. Sam's use of two plots of land to produce construction materials had been going on for a long time. In order to implement the State's policy of eliminating manual brick kilns, Ms. Sam's family had complied.
Regarding the origin of land use, Ms. Sam stated that she bought it from 3 households. However, according to the report of Nghia Hoan commune, this area is 5% land, managed by the commune, not eligible for consideration of granting land use right certificates to citizens. Regarding planning, this area has been planned for production and business, the land is currently left fallow, no household has been granted land use right certificates.
In the past, Tan Ky district, Nghia Hoan commune, and Tan Ky district Land Registration Office Branch have considered and resolved Ms. Sam's petition, but so far the citizens have not agreed.

Emphasizing that this is the first case of granting a land use right certificate, Chairman of the Provincial People's Committee Nguyen Duc Trung said that the authority to grant a land use right certificate belongs to the Chairman of the District People's Committee.
Therefore, to ensure the legal and legitimate rights of citizens, Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the Chairman of the Tan Ky District People's Committee to establish a working group to review and confirm specifically and accurately the origin, usage process, and purchase and sale process. On that basis, determine whether the two plots of land are eligible for land use right certificates to citizens or not, then respond to citizens in writing before January 30, 2024 and report to the Provincial People's Reception Council.
During the implementation process, the Department of Natural Resources and Environment guides Tan Ky district to consider and resolve the issue in accordance with legal regulations. In case the citizen still disagrees after the resolution, the citizen has the right to exercise the right to complain in accordance with regulations.
Regarding Mrs. Sam's household and other households that previously had land for construction material production, the Chairman of the Provincial People's Committee requested Tan Ky district to address the issue of reorganizing production activities and calling for businesses to invest in order to ensure legitimate rights for the people.
