Do I need to register with the local police station to rescue people during a fire?

National Assembly representative Nguyen Van Manh proposed that individuals who volunteer to participate in fire prevention and rescue in emergency situations do not need to register with the commune-level police where they reside.


Policies are needed to encourage volunteers to participate in fire prevention and control.

This morning (November 1st), during the discussion on the draft Law on Fire Prevention, Fighting, and Rescue, National Assembly representative Nguyen Van Manh ( Vinh Phuc delegation) expressed his basic agreement with the contents of the Report explaining, receiving feedback, and revising the draft law; he also stated that this draft law has demonstrated a spirit of innovation in lawmaking thinking.

Representative Mạnh stated that Clause 2, Article 39 stipulates that individuals wishing to volunteer for fire prevention and rescue activities must register with the commune-level police where they reside so that they can be mobilized when needed.

"So, is directly resolving an emergency situation a condition?", Mr. Mạnh asked.

A representative from Vinh Phuc province stated that, in reality, many people have volunteered to participate in rescue operations in emergency situations to save lives when official forces are not yet available.

"Recently, a young man rescued several people from a fire on Trung Kinh Street, Trung Hoa Ward, Cau Giay District, Hanoi, before the authorities could arrive at the scene," Mr. Manh said.

Based on the above content, Mr. Mạnh suggested that the phrase "except in cases of volunteer fire prevention and rescue in emergency situations" should be added to the end of Clause 2, Article 39.

Mr. Mạnh also proposed supplementing state policies to encourage volunteer participation in fire prevention and control, and expanding the scope of volunteer fire prevention and control in emergency situations, entrusting the Government with the task of specifying the details of this provision.

Representative Mạnh also suggested considering adding a provision stipulating that the People's Committee at the commune level is responsible for providing information on the list of agencies and organizations belonging to the Fire Prevention and Rescue Force, and police agencies in the commune, along with hotlines and contact addresses, so that people know and can choose the nearest place to report fires or rescue operations when necessary.

Proposal to add fire protection to high-rise apartments

Representative Vu Hong Luyen (from Hung Yen province) proposed adding fire safety measures for high-rise apartment buildings because many buildings have been in use for a long time, their infrastructure is deteriorating, and they are prone to fires and explosions.

According to Representative Luyen, high-rise apartment buildings are densely populated areas with a high risk of fire and explosion. Many high-rise apartment buildings were constructed a long time ago, and during use, damage or repairs to technical systems have occurred, leading to inadequate fire prevention, firefighting, and rescue operations.

Delegates argued that regulations are needed regarding access roads to high-rise apartment buildings to ensure that specialized fire and rescue vehicles can reach them in the event of a fire or explosion, in order to minimize damage to people and property.

Furthermore, escape skills are especially important for the public. To protect themselves and those around them, minimize casualties, and improve coordination with rescue forces in the event of fires or explosions, Representative Luyen suggested that the drafting agency research and add more detailed and specific regulations on escape skills.

Accordingly, the responsibilities of those who receive training and professional development in fire prevention, firefighting, and rescue are supplemented.

"This is to ensure that escape skills are not just about theoretical knowledge and skills, but become a natural reflex for every citizen when any fire or explosion, big or small, occurs," Ms. Luyen said.

Remove the regulation designating fire prevention and firefighting services as a conditional business sector.

Earlier, the National Assembly heard the Chairman of the National Defense and Security Committee, Le Tan Toi, present the report explaining, receiving feedback, and revising the draft Law on Fire Prevention and Rescue.

Mr. Le Tan Toi stated that, in response to the opinions of National Assembly deputies, the Standing Committee of the National Assembly has directed the thorough review and incorporation of the draft Law's content in accordance with current legal regulations. The draft Law will be researched, supplemented, and refined to ensure comprehensive coverage and compatibility between its scope and content.

Regarding fire prevention, the draft Law has separated Article 17 on Fire Prevention for Residential Buildings into two articles: one on Fire Prevention for Residential Buildings (Article 19) and one on Fire Prevention for Residential Buildings combined with Production and Business Activities (Article 20).

At the same time, classify and supplement more complete and appropriate regulations for these two types; supplement full regulations on fire prevention for facilities and specifically demonstrate in Article 22 of the draft Law that has been absorbed and revised.

The regulations on fire safety in the installation and use of electricity for domestic and industrial purposes will be comprehensively reviewed and revised to ensure feasibility and avoid overlap with existing laws.

Regarding regulations on fire prevention and fighting services, Chairman Le Tan Toi stated that the National Assembly Standing Committee agreed with the above opinions that it is necessary to implement the Party's policy of "promoting the socialization of fire prevention and fighting work," creating more favorable conditions for establishments and businesses in consulting, designing, constructing, manufacturing, importing, and trading fire prevention and fighting equipment and vehicles, and encouraging individuals and organizations to participate in fire prevention and fighting and rescue activities.

Therefore, in order to incorporate the opinions of delegates and create uniformity in the legal system, the Standing Committee of the National Assembly directed the removal of the provision that fire prevention and fighting services are a conditional investment and business sector from this draft Law, and at the same time proposed amending the 2020 Investment Law.

In addition, the draft Law has incorporated, revised, and supplemented regulations on financial sources and ensuring conditions for fire prevention and rescue activities, redesigned the transitional provisions, and separated a provision on handling facilities and structures that do not meet fire safety requirements but were put into use before the Law came into effect.
