Increase the number of centers with extra teaching functions
At the end of March, the Ministry of Education and Training held an online conference with 63 departments of education and training on high school graduation exams, primary school admissions, and the implementation of Circular 29 on the management of extra teaching and learning. Speaking at the conference, Mr. Tran The Cuong, Director of the Hanoi Department of Education and Training, said that since Circular 29 took effect, the number of centers with extra teaching functions has increased significantly, with an estimated 15,000 centers and businesses related to extra teaching established. Similarly, Mr. Nguyen Bao Quoc, Deputy Director of the Ho Chi Minh City Department of Education and Training, said that the number of extra teaching and learning units in individual business households is more than 10,000.

According to the Department of Education and Training of Bac Ninh , when implementing Circular 29, the Department has coordinated with relevant agencies to guide the registration of business in teaching and learning. Up to now, the whole province has 923 organizations and individuals registered, of which 673 are enterprises and 250 are affiliated units. There are 1,063 teachers registered to teach outside of school, the most are secondary school teachers (685 people), there are 378 high school teachers.
Need to specify the conditions for granting certificates of tutoring
Thus, with Circular 29, if an individual has the right conditions to teach according to regulations, registering as a business household is quite convenient. However, if registering for a business household certificate is too easy, it will also contain many risks, such as how to control safety, fire prevention, facilities, classroom area, teaching plan content, desks and chairs... in family tutoring classes.
It is known that Ms. NTMA is a reputable and well-known retired junior high school math teacher in Dien Khanh District, Khanh Hoa . After retiring, she opened a private tutoring class at home with 100 students for 4 classes. She used the living room to teach, so the classroom did not meet the minimum area, the tables and chairs were not in accordance with the standards, there was no fire extinguisher and she had not been trained in fire prevention and fighting... Therefore, when Circular 29 was issued, she was worried that she would not be qualified to apply for a household business registration to teach. However, after only 5 days of submitting the application, she was granted a household business registration certificate by the district finance and planning department without having to check the conditions for being allowed to do business as she was worried.
This has led to some teachers asking their relatives, mostly retired teachers, to apply for a legal household business license, legalizing their tutoring. In fact, there is now a service called "Requesting a Business License" for teachers who want to tutor with a fee of about 1 million VND, contributing to the increase in the number of business registrations as mentioned above.
Based on the above reality, the Ministry of Education and Training and the District People's Committee need to have specific regulations on the conditions for being granted a certificate of registration for a business household for tutoring and learning. That is, the business household must ensure the area of the classroom/number of students; fire prevention system according to regulations; standard tables and chairs; lighting system; teaching plan; lesson plan; time and duration of teaching period, budget framework...

There must be pre-control and post-control; avoid "the king's law is weaker than the village's custom"
When an individual fully meets the requirements as prescribed, the competent authority will issue a business registration certificate. Circular 29 does not prohibit tutoring, but it is necessary to bring tutoring outside of school into order and consider it a conditional business.
Only when tutoring and learning are considered a conditional business, will tutoring and learning establishments be subject to comprehensive management and fully comply with legal procedures on the implementation of business rights and obligations. Currently, with Circular 29, only household business licenses for tutoring are granted, so management is not based on the regulations of a conditional business according to the Business Law. This leads to the district finance and planning department issuing business registration certificates without pre-inspection or post-inspection.
Granting business registration certificates without pre-inspection or post-inspection by competent authorities will result in the rights of students taking extra classes at licensed businesses not being guaranteed.
In order for extra teaching and learning to become regular, the Ministry of Education and Training issued Circular 29, which is necessary, reasonable, and fair regarding students' right to study, teachers' right and obligation to teach extra (the right to freedom of business and the obligation to pay taxes). The most important thing is that the implementation of Circular 29 must be drastic, decisive, discussed and monitored to avoid "the king's law is defeated by the village's custom", where some places do it and others do not, and localities do it resolutely and others do it perfunctorily.
The Ministry of Education and Training should soon advise the Government to submit to the National Assembly to make tutoring and learning a conditional business line. We hope that the management of tutoring and learning will be effective if we do not ban tutoring and learning.
