List of businesses that defaulted on rice tenders in the Hanoi area in 2023.
According to information released by the Hanoi Regional State Reserve Bureau, in 2023, four businesses were fined for "abandoning" their contracts to supply rice for the national reserve.
Dong Phuong General Trading Company Limited (Dong Phuong Company), located at the house of Ms. Bui Thi Quy, Kim Village, Vu Lac Commune, Thai Binh City, Thai Binh Province, was fined 665 million VND. The reason is that the company refused to fulfill a contract to supply 1,000 tons of rice.
Van Loi Company Limited (Van Loi Company), located in Bao Cuu village, Thanh Chau ward, Phu Ly city, Ha Nam province, represented by Mr. Phan Doan Tien, Director, was fined 786 million VND for refusing to fulfill a contract to supply 1,200 tons of rice.
In addition, two joint venture companies, Khai Minh International Trading Co., Ltd. (Khai Minh Company), located at HH4 - Nam An Khanh Urban Area, An Khanh Commune, Hoai Duc District, Hanoi, and Vietnam Construction and Project Development Co., Ltd., were fined over 598 million VND. The reason for the fine was the joint venture's refusal to fulfill the contract to supply 800 tons of rice for national reserves in 2023.
It is known that the three contractors, Dong Phuong Company, Van Loi Company, and Khai Minh Company, were also previously fined by the Thai Binh Regional State Reserve Bureau.
Many businesses have previously defaulted on rice contracts.
2023 was not the first time the Hanoi Regional State Reserve Department penalized businesses for defaulting on rice bids.
Previously, the Hanoi Regional Reserve Bureau had identified five businesses that had "fled" and failed to supply rice to the national reserve.
According to information from the Lao Dong Newspaper, the Hanoi Regional State Reserve Department has released information regarding contractors violating legal regulations on bidding for the supply of rice for national reserve storage in 2020.
Ha Nam Ninh Foodstuff Joint Stock Company, located at 1A Street, Thanh Chau Ward, Phu Ly City, Ha Nam Province, was fined 419 million VND.
Ha Tinh Foodstuff Joint Stock Company, located at 18 Dang Dung Street, Nam Ha Ward, Ha Tinh City, Ha Tinh Province, was fined 125 million VND.
Chuong Tho Trading Company Limited, located in Kim village, Vu Lac commune, Thai Binh city, Thai Binh province, was fined 223 million VND.
Minh Khai Trading Joint Stock Company, located at 23 Minh Khai Street, Hoang Van Thu Ward, Hong Bang District, Hai Phong City, was fined 344 million VND.
Thuy Long Ha Nam Limited Liability Company, located in Dong Lu Ha village, Chan Ly commune, Ly Nhan district, Ha Nam province, was fined 280 million VND.
These contractors were fined for winning bids to supply national rice reserves in 2020 but refusing to finalize and sign the contracts.
In accordance with Clause d, Point 8, Article 11 of the Law on Bidding, the Hanoi Regional State Reserve Department has collected the bid security deposits from the violating bidders and remitted the entire amount to the state budget. The total amount is over 1.3 billion VND.
As Lao Dong newspaper has analyzed, the fact that businesses are defaulting on bids for national rice reserves raises questions about the penalties for such actions.
Many businesses defaulted on bids for national rice reserves, but these businesses were only fined and none were banned from bidding.
In 2020, in addition to fines, the Ministry of Finance proposed banning participation in bidding for the supply of national reserve goods for those who failed to fulfill or only partially fulfilled the contract to supply national reserve goods.
However, in an interview with Lao Dong newspaper, a representative from the Department of Reserve Management (Ministry of Finance) stated that contractors with a history of "breaching contracts" are not currently banned from bidding but only have their reputation points deducted.
Therefore, with the current monetary penalties and lack of bidding bans, it is difficult to put an end to the situation where businesses supplying rice for national reserves "default on bids," affecting the national food reserve goals. This phenomenon has occurred and continues to occur in many places and at various times.
