Proposal to exempt liability when risks occur in scientific and technological research

The Government proposes that heads of agencies, officials and civil servants participating in developing and promulgating resolutions to remove bottlenecks and promote scientific and technological activities be considered for exclusion, exemption or reduction of responsibility if negative impacts occur.

On the morning of February 15th, Minister of Information and Communications Nguyen Manh Hung, acting on behalf of the Prime Minister, presented the draft Resolution of the National Assembly on piloting a number of policies to remove obstacles in national science, technology, innovation, and digital transformation activities.

Regarding the necessity of issuing the resolution, according to Minister Nguyen Manh Hung, the Politburo has already issued Resolution 57. Regarding breakthroughs in national science , technology, innovation, and digital transformation, there are many revolutionary tasks and solutions. The immediate priority is to quickly institutionalize a number of specific tasks and solutions, and pilot projects related to national science, technology, innovation, and digital transformation.

"The 2013 Constitution also stipulates that the development of science and technology is a top national priority, playing a key role in the socio-economic development of the country," Minister Nguyen Manh Hung said.

In addition, the Minister stated that Resolution 158 of the National Assembly also emphasizes the need for strong and decisive solutions to remove institutional obstacles and overcome bottlenecks; further promote the review, supplementation, and improvement of institutions, laws, mechanisms, and policies associated with enhancing the effectiveness and efficiency of law enforcement…

Regarding practical considerations, Minister Nguyen Manh Hung stated that during the implementation of laws on innovation, some aspects were deemed unsuitable, such as obstacles to the autonomy of public science and technology organizations; the lack of regulations allowing civil servants to participate in managing businesses to promote the commercialization of research results; and regulations on risk acceptance in scientific research and technological development that are not in line with practical realities.

Regarding national digital transformation, Resolution 57 advocates for the development and shared use of national and regional digital platforms, ensuring unified and interconnected operation across sectors and fields; developing socio-economic development and preventing the risk of falling behind by creating breakthroughs in digital transformation, and rapidly and comprehensively implementing important projects such as Project 06 and the smart operation center.

Resolution 57 also calls for the development of telecommunications infrastructure and secure, sustainable internet connectivity; nationwide coverage of 5G and 6G mobile networks… However, currently, low-orbit satellite technology is mainly owned and deployed by a few foreign companies worldwide, so mechanisms and policies are needed to attract and facilitate foreign investment in developing low-orbit satellite technology in Vietnam, while ensuring national defense and security.

Currently, Vietnam does not have semiconductor chip manufacturing plants, so after designing chips in Vietnam, they have to be sent abroad for production, which is time-consuming and also poses many risks to semiconductor chip security.

According to Minister Nguyen Manh Hung, the resolution aims to pilot a number of specific mechanisms and policies to remove obstacles; the policies must have outstanding incentives to remove obstacles and help major projects move forward, impacting other activities. With a spirit of innovation, this will help Vietnam successfully implement science, technology, innovation, and digital transformation with advanced digital infrastructure, develop Vietnam's digital technology industry, and realize the goal of economic growth of 8% or more in 2025 and double-digit growth in subsequent years.

Regarding science, technology, and innovation, the draft Resolution stipulates a mechanism for autonomy and accountability in organization, personnel, finance, and expertise; it also allows civil servants and managerial staff working in public science and technology organizations to participate in establishing, managing, and operating enterprises that commercialize research results. It adds provisions for exemption from liability in the event of risks in scientific research and technological development.

The regulations stipulate the principles for applying lump-sum payments to science and technology tasks using state budget funds, including lump-sum payments based on the final product. They also stipulate the principles for allocating state funds to science and technology tasks through a fund; and provide tax incentives for science, technology, and innovation activities…

Regarding the content of national digital transformation, the draft Resolution clearly states that, for national digital transformation activities, including shared digital platforms, contracts will be awarded through designated bidding packages. For digital infrastructure development activities, including 5G infrastructure, international undersea telecommunications cables, and pilot telecommunications services using low-orbit satellite technology, the central budget will support the construction of small-scale semiconductor chip manufacturing plants. For the development of strategic digital technology industries (semiconductors), the central budget will provide support for the construction of small-scale semiconductor chip manufacturing plants.

Regarding implementation, the regulations stipulate that the heads of agencies and units; and officials and employees involved in developing and promulgating the mechanisms and policies specified in the resolution aimed at removing bottlenecks and promoting national science, technology, innovation, and digital transformation will be considered for exemption, waiver, or mitigation of responsibility if the implementation of the resolution results in negative actions, group interests, or waste.
