On the afternoon of November 5, at the National Assembly House, the National Assembly Standing Committee held its 51st session.

Politburo member and National Assembly Chairman Tran Thanh Man attended the meeting. Vice Chairman of the National Assembly Vu Hong Thanh chaired the content of the National Assembly Standing Committee giving opinions on the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.

Briefly presenting the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, Minister of Agriculture and Environment Tran Duc Thang said that it is necessary to issue a Resolution of the National Assembly to continue institutionalizing the Party's viewpoints and orientations, and at the same time remove a number of difficulties and obstacles in the process of organizing the implementation of the Land Law.

The Draft Resolution is structured into 3 chapters and 13 articles; the basic content includes 3 major groups of issues.

The first group, the contents of institutionalizing viewpoints, goals, tasks, and solutions according to the Resolution of the Central Executive Committee and the Conclusion of the Politburo.

The second group, the contents of resolving "bottlenecks" have been pointed out in Notice No. 08-TB/BCĐTW of the Central Steering Committee on perfecting institutions and laws.

The third group, contents to continue removing difficulties and obstacles in the process of implementing the Land Law.

Presenting the report on the above content, Chairman of the National Assembly's Economic and Financial Committee Phan Van Mai said that the Standing Committee of the Committee basically agreed with the necessity of issuing a Resolution of the National Assembly on mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the 2024 Land Law, but it is necessary to pay attention to some contents.

Accordingly, regarding cases of land reclamation by the State (Article 3), according to the Standing Committee of the Committee, reviewing cases of land reclamation to suit practical requirements, removing bottlenecks, and unblocking resources is necessary, but it is necessary to strictly comply with legal regulations to protect the legitimate rights of land users. Land reclamation must meet the requirements of real necessity for the purpose of national defense, security, socio-economic development, for the national and public interest, and must be public and transparent, not giving rise to inadequacies, especially new complex issues in practice, ensuring compliance with the Constitution; it is necessary to assess the impact of policies, especially negative impacts.

Regarding the principles of land valuation, time of information collection, and land valuation methods (Article 6), the Standing Committee of the Committee believes that land valuation according to market principles is necessary to move towards a transparent and fair real estate market. However, the implementation process needs to be cautious, with a clear roadmap, and scientific and objective valuation methods. Strengthening the database and enhancing the monitoring role of independent agencies will help address current challenges, ensuring the success of the policy...

Speaking at the session, National Assembly Chairman Tran Thanh Man requested the resolution drafting agency to closely follow the Party's viewpoints and policies on removing difficulties and obstacles in organizing the implementation of the Land Law; be consistent with the two-level local government model and promptly resolve current bottlenecks as well as promote administrative procedure reform on land and digital transformation based on a unified and integrated land database system.

Concluding the session, Vice Chairman of the National Assembly Vu Hong Thanh requested the Government to continue directing the review of the draft resolution's contents. The draft needs to closely follow and be consistent with the guidelines and policies, especially the new resolutions of the Politburo, and pay attention to 6 groups of contents.

In particular, continue to review and fully synthesize difficulties and problems in the process of organizing the implementation of the 2024 Land Law to have timely solutions in this Resolution.

In addition, carefully review and agree on the effective date of the Draft Resolution. Fully and comprehensively identify cases where a transitional mechanism needs to be applied to best handle problems and inadequacies arising in practice when this Resolution comes into effect. It is necessary to avoid missing cases where there are policy changes between the Draft Resolution and the provisions of the current Land Law.
