
Regarding this issue, Tin Tuc and Dan Toc newspaper reported as follows:
According to current regulations, the conditions for employees to be able to retire at a lower age than the prescribed retirement age under normal working conditions, but not more than 5 years, are having paid compulsory social insurance for at least 15 years and falling into the following cases: having reduced working capacity; doing particularly arduous, toxic, dangerous jobs; doing arduous, toxic, dangerous jobs; working in areas with particularly difficult socio -economic conditions.
On the other hand, at Point a, Clause 1, Article 38 of the 2025 Law on Employment (effective from January 1, 2026) stipulates that employees who are paying unemployment insurance are entitled to unemployment benefits when terminating their labor contract, employment contract or terminating their employment in accordance with the provisions of law without falling into one of the cases where the employee unilaterally terminates the labor contract illegally according to the provisions of the Labor Code or the employee quits the job when eligible for pension.
Based on the above regulations, employees who are eligible for pension benefits 5 years earlier than the prescribed retirement age under normal working conditions will not be entitled to unemployment benefits from January 1, 2026.
