The right to recruit and transfer public school teachers is assigned to the Department of Education and Training, without overlapping with the commune level.
The above content is included in the Circular on functions, tasks and powers of the Department of Education and Training and the Department of Culture and Social Affairs, announced by the Ministry of Education and Training on July 30.
Accordingly, the Department has the right to establish a school board, replace the chairman of the school board, the principal, and vice principal. For public schools under the management of two or more communes or wards, the Department has the right to appoint the principal and vice principal.
Based on the decentralization of the Provincial People's Committee, the Department has the right to receive, recruit, mobilize, second and transfer teachers and workers in public schools.
Meanwhile, the Department of Culture and Society in communes and wards will advise and submit to the committees at the same level plans for recruiting teachers; manage job positions and teacher structure in the locality.

At a workshop of the Ministry in mid-July, Mr. Nguyen Van Phong, Deputy Director of the Department of Education and Training of Ho Chi Minh City, acknowledged that the right to recruit teachers after the two-level government operates has not been clarified.
Specifically, according to Decree 142 of the Government, the Department is authorized to recruit and appoint teachers, civil servants, and employees in public educational institutions. According to the Law on Organization of Local Government (Law 72/2025), the Chairman of the People's Committee at the commune level is responsible for recruiting, appointing, and managing civil servants and public employees in the area.
Mr. Phong and Mr. Dinh Ngoc Son, Deputy Director of the Department of Education and Training of Quang Ninh province, proposed that the Department be given the authority to recruit and transfer teachers, because many communes and wards currently do not have education officials and have few schools.
The Law on Teachers was passed by the National Assembly on June 16. One of the notable provisions is to increase autonomy for educational institutions and delegate authority to the education sector in recruiting teachers, instead of the Department of Home Affairs and district-level People's Committees as before.
The country currently has more than 1.26 million teachers from kindergarten to grade 12. In the 2022-2026 period, the education sector was assigned about 109,000 positions, while about 60,000 positions have not been used.
Being given the right to recruit is considered a solution for the education sector to solve the teacher shortage.
