National scientific conference "Improving the structure of Vietnam's legal system to meet the requirements of national development in the new era"

On the morning of November 1, the Ministry of Justice, the Central Committee for Internal Affairs, and the Committee for Law and Justice jointly organized a national scientific workshop on "Improving the structure of Vietnam's legal system to meet the requirements of national development in the new era".

Attending the workshop were representatives of leaders of central ministries and branches, leaders and representatives of several provinces and centrally run cities; experts, scientists, managers and practitioners.

The workshop was organized to help the Ministry of Justice, the Committee for Law and Justice and relevant agencies carry out the task of researching and developing the Project on Perfecting the Structure of the Vietnamese Legal System, meeting the requirements of national development in the new era, which was assigned by the Central Steering Committee on Perfecting Legal Institutions to the Party Committee of the Ministry of Justice to prepare, and the Project on Legislative Orientation for the 16th National Assembly Term, 2026 - 2031, which was assigned by the Politburo to the Party Committee of the National Assembly to prepare, with the Party Committee of the Committee for Law and Justice as the advisory body for implementation.

Speaking at the workshop, Head of the Central Internal Affairs Committee Phan Dinh Trac identified four important contents that need to be focused on perfecting the structure of the legal system. First, it is necessary to shift from management legal thinking to constructive legal thinking. The law does not only focus on controlling risks but also needs to guide, create opportunities, and encourage innovation while still ensuring order and discipline. Second , it is necessary to focus on reviewing, systematizing, cutting down intermediate levels, eliminating overlapping and conflicting regulations, moving towards a streamlined, unified, transparent and easy-to-implement legal system. Third, comprehensively innovate the law-making process in a scientific and transparent direction, preventing group interests and local interests in policy-making. Fourth, strongly innovate law enforcement work, closely link law-making and law enforcement, and aim to establish a complete legal life cycle from legislation, executive, judiciary to supervision, feedback and amendment.

The Head of the Central Internal Affairs Committee suggested some orientations to improve the structure of Vietnam's legal system. Accordingly, the construction of the legal system structure must ensure full coverage, balance, and reasonable harmony between fields; increase the promulgation of legal documents, especially legal documents to more clearly demonstrate the role of creating development of the Vietnamese socialist rule of law state in the new era, in addition to performing the current management role.

The Head of the Central Internal Affairs Committee also pointed out that it is necessary to continue researching to reduce the levels of the legal document system, narrowing the types of legal documents that a competent authority can issue in the direction that each agency only prescribes one form of legal document. Continue to pay attention to perfecting legislative techniques and modernizing infrastructure, applying advanced technologies in law-making work. Along with that, conduct a general review of legal documents to handle overlapping, contradictory and inadequacies of the current legal system...

At the workshop, experts, leading scientists, and representatives of agencies participating in the workshop contributed many profound, intelligent, and highly responsible opinions. The opinions closely followed the viewpoints, goals, orientations, and solutions to continue promoting innovation, building, developing, and protecting the country and the Fatherland in the new period set out in the draft documents of the 14th National Congress and the very profound directives with the long-term strategic vision of the Politburo, the Secretariat, the General Secretary, and the Central Steering Committee on perfecting the legal system.

The opinions at the workshop, along with the presentations in the workshop proceedings, were carefully selected, contributing to clarifying the advantages of the current structure of the Vietnamese legal system as the result of the tireless efforts of the National Assembly, the Government, central ministries, branches and localities, with the great contributions of many generations of officials in the legal field over the past 80 years under the leadership of the Party.

In addition, the reports also pointed out limitations, inadequacies, issues that need to be researched and resolved, good international experiences and many recommendations to improve the structure of Vietnam's legal system, meeting the requirements of national development in the new era.

In his closing speech at the workshop, Vice Chairman of the National Assembly Nguyen Khac Dinh emphasized that the Project on Completing the Structure of the Vietnamese Legal System to Meet the Requirements for National Development in the New Era and the Project on Legislative Orientation for the 16th National Assembly Term (2026 - 2031) are two very large and important projects that are closely related to each other. In particular, the results of the Project on Completing the Structure of the Legal System are the blueprint, the guiding theoretical ideology, paving the way for the construction and completion of the legal system with a long-term vision, both managing and promoting and creating national development in the new era. Based on that master plan and from the requirements for national development, the Project on Legislative Orientation for the 16th National Assembly Term determines the list of laws that the National Assembly must consider passing new ones or amending and supplementing during the entire term.

The Vice Chairman of the National Assembly respectfully thanked and highly appreciated the presentations and opinions of the delegates; at the same time, he pointed out that this is a very valuable source of information, both theoretical and practical, for the Ministry of Justice, together with the Committee on Law and Justice and relevant agencies, to continue to study, filter, absorb and use in the process of building and perfecting the Projects.

Immediately after this workshop, the Vice Chairman of the National Assembly pointed out that there is a lot of work to be done to build successful projects, ensuring quality requirements, on schedule, and meeting the very high requirements assigned by the competent Party agencies. The Vice Chairman of the National Assembly requested that the assigned agencies coordinate closely and absorb as much as possible opinions to continue perfecting the projects.
