Ms. Trinh Thi Thi, residing in Cao Nhan 3 residential group, Le Ich Moc ward, Hai Phong city, reported that Mr. Do Van Chi's household living next door encroached on land and fenced the path leading to the agricultural production garden, affecting the legal land use rights and causing economic losses to her family.
In the petition, Ms. Thi stated: Her family has more than 7,490 square meters of reclaimed land in the alluvial area outside the Thai Lai Cooperative dike since 1990. This is land reclaimed by people according to the local economic development policy at that time and has been her family's only source of income for the past 35 years.
During the land use process, Ms. Thi's family, along with Mr. Pham Van Deo and Mr. Pham Van Quan's families in the same village, built and shared a 2.5 meter wide alley to go to the dike. All three households also shared the same electricity line since 2002 to serve their daily life and production, without any disputes.
In 2017 and 2020, Mr. Quan's household and Mr. Deo's household respectively transferred land to Mr. Do Van Chi, who is currently operating a shipbuilding facility in the area. At the same time, he transferred the power lines, electric poles, and meters to Ms. Thi's family for normal use. After that, Mr. Chi asked Ms. Thi's family to transfer the land area they were using but was not agreed.
In July 2025, Mr. Chi had people arbitrarily pull down the electric pole and fence the family's path. In September 2025, Mr. Chi continued to build a gate, preventing Ms. Thi from entering and exiting her family's land. Ms. Thi said that the fencing and gate made her family completely lose access to the farmland, making it impossible for her family to harvest crops, especially the banana plantation that was in the harvest season, causing great economic losses.
Talking to reporters of Hai Phong Newspaper and Radio and Television, Ms. Do Thi Nga, Head of Cao Nhan 3 residential group, Le Ich Moc ward, said that the land area Mr. Chi is using is land rented from the People's Committee of the old Thuy Nguyen district under a contract, used as a shipbuilding facility for many years.
Recently, Mr. Chi expanded the production area, built a fence around and a gate to the rented area, making it difficult for Ms. Thi's family to get to the garden at night or during lunch break.
People's Committee of Le Ich Moc Ward assigned the Cao Nhan 3 residential group to organize a meeting and mediation between the two sides on October 19, requesting that both sides reach an agreement to resolve the matter “reasonably and emotionally”. However, due to the lack of consensus on land use boundaries and the right to open a path, the conflict continues.
Regarding this incident, on December 2, Mr. Do Van Chi, Director of Chi Linh Company Limited, said that the company rented land under contract No. 20/HD-TD signed with the People's Committee of the old Thuy Nguyen district, the lease term was from 2010 to 2030. The person who signed the contract was Mr. Nguyen Van Binh, a shareholder of the company. Since taking over this land, there has been no common path as Ms. Thi reported. However, Mr. Chi still created conditions for Ms. Thi to go back and forth to the land to do gardening.
Recently, when expanding production, the company installed an additional gate to manage assets and only opened the gate during business hours, making it difficult for Ms. Thi's family to pass through as before.
Ms. Tran Thi Ngoc My, an officer of the Economic, Infrastructure and Urban Affairs Department of Le Ich Moc Ward, informed that the ward has received the citizen's feedback. In the coming time, the locality will continue to invite relevant parties to work, and at the same time, check land records over many periods, clarify the boundaries as well as the process of forming common paths between land plots.
Because the land Mr. Chi uses is leased under a contract with the People's Committee of the old Thuy Nguyen district, and the land Mrs. Thi cultivates is previously reclaimed land, the legal factors overlap and need to be carefully considered. The ward's viewpoint is to ensure the legitimate rights of both parties and maintain local security and order.
Lawyer Tran Van Tam, VIP Law Firm, Hai Phong City Bar Association analyzed that the 2015 Civil Code stipulates that when a plot of land is surrounded, has no or insufficient access to a public road, the land user has the right to request the user of the adjacent plot of land to reserve a reasonable access for him.
The opening of a passage must ensure the harmony of interests and limit the damage to the party giving the passage; at the same time, the party receiving the passage must compensate appropriately, except in cases where the passage has been established stably before. In the case of Mr. Chi's land being leased from the State, the change of the current status and the erection of a fence must comply with the leased land boundary and must not infringe upon the legitimate rights of adjacent households.

The Ward People's Committee needs to re-measure the current land status, determine the actual route and mediate according to the correct procedure. If the mediation fails, the people have the right to file a lawsuit in court to request determination of the legal route.
