Kinhtedothi - According to Standing Committee Member of the City Party Committee, Vice Chairman of the Hanoi People's Committee Nguyen Trong Dong, Resolution No. 171/2024/QH15 is an important legal basis to resolve the main bottleneck of problems in stalled commercial housing projects.


On the afternoon of December 25, a conference was held to disseminate and implement the Laws and Resolutions passed at the 8th Session of the 15th National Assembly. Prime Minister Pham Minh Chinh and National Assembly Chairman Tran Thanh Man chaired the conference.

The conference was organized by the Government, the National Assembly Standing Committee, and relevant agencies, and was connected online nationwide from the Government headquarters to the headquarters of the People's Committees of provinces and centrally run cities.

Also attending were Politburo member, Permanent Deputy Prime Minister Nguyen Hoa Binh; Party Central Committee members, Deputy Prime Ministers, Vice Chairmen of the National Assembly, leaders of ministries, branches, central agencies and localities.

The conference listened to the Government's report on the implementation of laws and resolutions passed at the 8th Session of the 15th National Assembly; leaders of ministries, branches, central and local agencies reported and gave comments.

At the Hanoi People's Committee bridge, Vice Chairman of Hanoi People's Committee Nguyen Trong Dong presented a speech on the impact of the pilot policy of implementing commercial housing projects through agreements on receiving land use rights or having land use rights in the management of the real estate market and development of social housing in the city in the coming time.

Many projects are still in a "frozen" state waiting for resolution.

Accordingly, Hanoi is the second most populous locality in the country and has the second highest population density among 63 provinces and centrally-run cities. Hanoi's population density in 2023 is 8.4 times higher than the national population density; on average, the capital's population increases by about 200,000 people each year. Such a rapid increase in population is putting great pressure on the capital's infrastructure system of education, health care, urban transport, environment, urban civilization and especially the housing issue.

According to the Vice Chairman of the Hanoi People's Committee, in order to meet the housing needs of the people (the expected population density by 2025 is 3,119 people/km² and by 2030 is 3,557 people/km²), Hanoi has proactively and actively implemented many programs and plans to call for businesses to participate in investing in the construction of commercial housing projects through the following forms: auctioning land use rights, receiving land use rights transfers and allowing land use purpose changes for land users who currently have land use rights.

Along with that, the city has issued programs and plans to develop housing and social housing in the area, creating a supply source to serve people's needs such as: developing social housing, resettlement housing, commercial housing, renovating and rebuilding old apartments...

Accordingly, the city has completed 25 social housing projects with 1,254,087m². There are currently 57 projects under implementation with 5,339,346m²; there are 19 completed resettlement housing projects with 371,656m² of floor space corresponding to 4,684 apartments. There are 21 resettlement housing projects under implementation (with about 963,099m² of floor space corresponding to 13,870 apartments).

In addition, there are currently 89 commercial housing construction investment projects under implementation with a total floor area of ​​approximately 34,571,889m² corresponding to 164,568 apartments; 4 projects to renovate and rebuild old apartment buildings have been completed and put into use, and 14 projects are being implemented with non-budgetary capital.

At the same time, the city has invested in 12 houses arranged as official residences with a total floor area of ​​about 963.08m². Implemented the construction of 10 student housing projects including 2 centralized dormitory projects and 8 dormitory projects at a number of universities...

Regarding the problem, Vice Chairman of Hanoi People's Committee Nguyen Trong Dong said that since July 1, 2015 (the 2014 Housing Law takes effect), according to the provisions of Article 23 of the 2014 Housing Law (amended and supplemented by the 2020 Investment Law and Law No. 03/2022/QH15), in addition to auctions and bidding, the conditions for land use to implement commercial housing projects are having the right to use residential land or residential land and other land; receiving the transfer of residential land use rights. This has led to many difficulties in the real estate market in Hanoi recently, with businesses having difficulty meeting the requirements on land types and completing legal procedures to implement investment in the construction of commercial housing; many projects are still in a "frozen" state waiting for resolution.

The City People's Committee has no basis to approve, decide on investment policies, and allocate land to investors to implement the project. As a result, the supply of housing funds in the city, especially housing funds for people with near-low incomes, is scarce (or the price is too high compared to the average income), while the population growth rate of the capital is increasing, so the need for housing is extremely urgent.

Solving congestion in many real estate business projects

From the above-mentioned problems, according to Vice Chairman of the City People's Committee Nguyen Trong Dong, the National Assembly's approval of Resolution No. 171/2024/QH15 dated November 30, 2024, is the basis, legal and practical conditions to resolve the bottlenecks in many real estate business projects, increase supply to the market, and positively impact the real estate market and housing development in the area.

Specifically, Resolution No. 171/2024/QH15 is an important legal basis to resolve the main bottleneck of stalled commercial housing projects. It is expected that about 281 projects with a total area of ​​about 2,189.67 hectares and about 3.15 million square meters of housing floor space will be resolved in the city.

The Resolution will specify the orientation of the Capital Planning, the General Planning for the Construction of Hanoi Capital approved by the Prime Minister and the orientation of the Urban Zoning Plans approved by the City People's Committee;

At the same time, create conditions for effective exploitation of land funds, combat waste of land resources in accordance with the direction of General Secretary To Lam, the Central Committee and the Government; overcome environmental pollution and promote economic growth and development of the Capital;

Forming civilized and modern housing areas, synchronous with technical and social infrastructure of the area; protecting the environment, ensuring fire prevention and fighting, and creating consensus and satisfaction of the people.

In addition, the Resolution will promote the real estate market under the direction of the Government, the Prime Minister and the Hanoi City Housing Development Program for the period 2021-2030 of the Hanoi People's Committee. By 2025, the city strives to develop 22.5 million square meters of new private housing, about 1.25 million square meters of social housing, 19.69 million square meters of commercial housing... Contributing to increasing the housing supply to meet part of the market demand and the expectation of lowering real estate prices in the coming time in the city. Thereby helping to ensure economic security in the housing sector and the real estate market, ensuring social security.

In order for the Resolution to be implemented soon, Hanoi City requests the Ministry of Natural Resources and Environment to promptly advise the Government to issue a Decree detailing a number of articles and measures to implement Resolution No. 171/2024/QH15 (implementing Clause 2, Article 5 of the Resolution).

"This is an important legal basis for the city to implement the next steps to concretize the National Assembly's guidelines and policies in piloting commercial housing projects through agreements on receiving land use rights or having land use rights in the city," emphasized Vice Chairman of the Hanoi People's Committee Nguyen Trong Dong.
