Foreigners are understood to be people with the nationality of another country who are studying, working, living and working in the territory of the Socialist Republic of Vietnam.
When residing in Vietnam, foreigners have equal legal capacity in administrative law, regardless of skin color, ethnicity, occupation or religion. Based on the nationality principle stipulated in the Nationality Law of the Socialist Republic of Vietnam, the administrative legal status for foreigners will have certain limitations compared to Vietnamese citizens. Therefore, foreigners who violate the law in Vietnam will also have their own handling regulations.
However, when participating in traffic in Vietnam, if foreigners violate traffic laws, they will be treated like normal Vietnamese citizens according to the law, without priority.
Accordingly, foreigners who have a driving license from their country of residence must complete the procedure to convert it to a corresponding Vietnamese driving license in order to be allowed to drive on the road. In case an international treaty on driving licenses to which Vietnam is a member has different provisions, the provisions of that international treaty must be followed.

Therefore, according to the law, foreigners must change to a Vietnamese driver's license to be able to drive. In case Vietnam is in a country with an international treaty, foreigners can use an international driver's license to drive in Vietnam. When violating, there will be the same form of punishment and penalty as Vietnamese citizens.
According to the law, foreigners who violate traffic laws will be handled based on the following process:
Step 1: Stop when asked by traffic police for inspection.
Step 2: Present the necessary documents for the traffic police to check, including: driver's license; vehicle registration and motorbike insurance. The traffic police will check the documents and traffic conditions of the vehicle.
Step 3: Penalize traffic violations in one of two cases.
- On-the-spot fines: for foreigners who violate Vietnamese traffic laws at a minor level, they will only be given a warning and will not be ticketed.
- Fines: for foreigners who commit more serious traffic violations, it is mandatory to make a record of the handling and confiscation of the driver's license. The fined person will have to go to the State Treasury to pay the fine before being able to get the driver's license back. In addition, at the present time, violators can pay the fine online at the national public service portal if they cannot pay directly at the State Treasury.
