Numerous changes have been made regarding the preparation and approval of urban and rural planning.

Urban and rural planning projects that were initially completed at the district level will be transferred to the provincial or commune level. Existing zoning plans can continue to be used for up to two years after the new law comes into effect (expected January 1, 2026).

The draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning (draft) is currently being reviewed by the Ministry of Justice , focusing on the organization of a two-tiered local government; strong decentralization, streamlining procedures, helping people and businesses access planning procedures faster, with fewer steps and lower costs...

Specifically, all regulations in the Law on Urban and Rural Planning have been revised according to the provincial and commune-level model. Tasks and powers previously under the district-level People's Committees have been transferred to the provincial level for important content (general urban planning, economic zones, national tourism zones, etc.) and to the commune level for content directly related to the community (commune planning, detailed planning, zoning within commune boundaries).

Eliminate town and district-level master plans (due to the lack of district-level organizations). For communes aiming to become urban areas, instead of creating a commune-level plan, a comprehensive urban plan should be developed directly.

Many powers of the Prime Minister and the Ministry of Construction have been transferred, including the authority to approve general urban plans and national tourism zone plans (previously under the Prime Minister), which has been transferred to provincial People's Committees.

The responsibility for appraising the master plan for national tourism areas (formerly under the Ministry of Construction) has been transferred to the provincial-level specialized departments.

The authority to approve detailed plans for defense and security projects has been transferred from the Prime Minister to the Ministry of Defense and the Ministry of Public Security.

The draft eliminates the procedure for approving the overall adjustment of the zoning plan, the procedure for reporting to the People's Council, and the procedure for soliciting opinions from the local community in some stages.

Provincial People's Committees can proactively issue regulations for management in accordance with the planning, without having to wait for the opinion of the Ministry of Construction.

In addition, the timeframes for preparing, reviewing, and approving planning documents have been shortened and clearly defined.
