Commenting on this content, National Assembly Chairman Tran Thanh Man emphasized that the Ordinance is a very important step forward in the Vietnamese legal system.

Need to synchronize the organization according to the new model

Presenting the content of the review, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi said: The Standing Committee of the Committee agreed with the scope of amendments and supplements to the draft Ordinance, focusing on amending and supplementing regulations on the subjects exercising the authority to conduct activities of inspecting the law compliance of agencies, organizations and individuals; inspecting vehicles, objects and locations when directly detecting signs of crime, administrative violations or when there are denunciations and reports of crimes and administrative violations according to the provisions of law; regulations directly related to the current arrangement of the state apparatus; on amending the name of the force to "Police for preventing and combating environmental crimes" to ensure compliance with current legal provisions.

Commenting on this content, National Assembly Chairman Tran Thanh Man agreed with the review report of the Committee on National Defense, Security and Foreign Affairs to retain the old name; at the same time, he said that the project was issued in the current urgent conditions, in the context of the complicated and sophisticated environmental violations that are taking place, seriously affecting people's health, sustainable development and non-traditional security.

The National Assembly Chairman noted that it is necessary to synchronize the organization of the apparatus according to the new model, such as: Supplementing regulations on transferring the authority previously at the district level to the commune level or the provincial environmental police department, with a digital support mechanism to ensure supervision at the grassroots level, amending the provisions so that the grassroots environmental police team is directly under the commune police, focusing on patrolling at the local level, to reduce gaps, and increase the effectiveness of handling small and scattered violations at the local level.

The National Assembly Chairman suggested expanding authority over new technology, inter-sectoral coordination in environmental treatment issues such as data sensors for real-time monitoring, especially in border or river areas; coordinating with the Ministry of Agriculture and Environment to handle agricultural pollution; coordinating with the Ministry of Health on food safety issues; and coordinating with customs to prevent waste smuggling.

The Ordinance needs to emphasize the strengthening of prevention and the role of the community, to raise awareness of prevention, education is the main thing. The National Assembly Chairman said that no matter how many environmental police there are, if people's awareness is not high, implementation will not be effective. In addition, it is necessary to properly handle industrial parks, export processing zones, and residential areas in discharging wastewater into rivers.

National Assembly Chairman Tran Thanh Man emphasized the general concern around measuring efficiency and periodically evaluating to have annual reports on efficiency index, number of cases handled, pollution reduction rate, used to assess environmental violations, using new technology tools today.

The National Assembly Chairman stated: This Environmental Police Ordinance is a very important step forward in the Vietnamese legal system, but it needs to be amended promptly to suit the conditions of our country's development in the period 2026-2030, economic and social growth but not to affect the environment. No matter how production and business are developed, the environment must be guaranteed.

Regarding the duties and powers of the Environmental Police in Article 7, Chairman of the Law and Justice Committee Hoang Thanh Tung proposed: The draft Ordinance amends Clause 5, Article 7 of the Environmental Police Ordinance in the direction of removing the Chief of Police at the district, county, town, city level and equivalent administrative units, and at the same time adding the unit of Police Station for consistency and synchronization.

Concluding this content, Vice Chairman of the National Assembly Tran Quang Phuong said that the National Assembly Standing Committee highly appreciated the agency in charge of drafting the draft ordinance, the Government agencies and the agency in charge of reviewing the good coordination to prepare the documents and submit them to the National Assembly Standing Committee in a timely manner.

The Standing Committee of the National Assembly agrees with the necessity of promulgating and basically agrees with the contents of the draft ordinance. To ensure the quality and completion of the draft ordinance, the Standing Committee of the National Assembly requests the drafting agency to carefully review the provisions in the draft to ensure consistency and synchronization with the legal system and to ensure consistency in the technical aspects of the document when merging with the current ordinance.

Regarding the name: Keep the name as the old ordinance because only amending and supplementing a number of articles. Supplementing the title: Replace the word "Border Guard Station" with "Border Guard Station Chief" such as "Commune and Ward Police Chief"; decentralizing and delegating power to the commune level and strengthening the Environmental Police force for the commune level; expanding the authority to apply new technologies; coordinating inter-sectoral coordination to monitor the environment in real time; at the same time emphasizing strengthening prevention, the role of the community and people's awareness of environmental protection.

Ensuring the operation of the Special Court

Presenting the Draft Law, Deputy Chief Justice of the Supreme People's Court Nguyen Van Tien stated that the draft Law consists of 43 articles and 5 chapters. The Draft Law stipulates the duties and powers; organizational structure; jurisdiction, order and procedures; enforcement of judgments and decisions; judges, court clerks, representatives of the parties; and ensuring the operation of the specialized court at the International Financial Center.

Also this morning, the National Assembly Standing Committee gave its opinion on the draft Law on Specialized Courts at the International Financial Center. Accordingly, the National Assembly Standing Committee highly appreciated the Supreme People's Court for actively preparing the draft Law dossier to be eligible to be submitted to the National Assembly for consideration and decision at the 10th Session according to the shortened procedure.

The National Assembly Standing Committee agreed with the provisions in the draft Law on the establishment of a specialized Court located in Ho Chi Minh City. The organizational structure of the Court includes the Court of First Instance, the Court of Appeal and the supporting apparatus. This is a very important agency that needs to be established soon to create confidence for foreign investors.

The National Assembly Standing Committee basically agrees with the major contents of the draft law, the outstanding mechanisms and policies. The application of the principles of the legal system in dispute resolution to be consistent with international practices, ensuring full synchronization of the institution for resolving disputes arising within the scope of the International Financial Center.

Concluding the session, National Assembly Standing Vice Chairman Do Van Chien stated that the National Assembly Standing Committee highly appreciated the Supreme People's Court for actively and promptly preparing the draft Law dossier to be eligible to be submitted to the National Assembly for consideration and decision at the 10th Session.

The Standing Vice Chairman of the National Assembly noted that the draft Law must ensure: specificity, superiority, following a set of rules but complying with international practices, with the goal of attracting international investors.

Also this morning, the National Assembly Standing Committee considered and approved the appointment of Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam abroad.
