With the majority of delegates voting in favor, this afternoon (December 3), the National Assembly voted to pass the Emergency Law.
The revised Law on State of Emergency includes 6 chapters and 36 articles. The Law stipulates the principles, order, procedures, and authority to declare, announce, and abolish a state of emergency; measures to be applied in a state of emergency; organization of implementation of resolutions and orders on the state of emergency; and responsibilities of agencies, organizations, and individuals in a state of emergency.
Accordingly, a state of emergency is a social state declared by a competent authority in one or more localities or nationwide when there is a disaster or risk of a disaster that seriously threatens human life and health, property of the State, agencies, organizations and individuals, or when there is a situation that seriously threatens national defense, national security, social order and safety.
State of emergency includes state of disaster; state of national security, social order and safety; state of national defense.
The Law also stipulates prohibited acts in a state of emergency such as opposing, obstructing, or not complying with the instructions, commands, and operations of competent authorities; taking advantage of the state of emergency for personal gain; providing false information about the state of emergency, etc.
Previously, the Law received comments from delegates on many issues such as clarifying the concept of a state of emergency to avoid abuse or delay in declaring a state of emergency; adding regulations on the responsibility of local authorities in receiving, synthesizing, and publicizing the results of handling feedback from people and businesses and ensuring communication in a state of emergency.
