
Passenger vehicles with more than 8 seats must install surveillance cameras in the passenger compartment.
On the morning of December 10th, with an overwhelming majority of delegates voting in favor, the National Assembly officially passed the Law amending and supplementing a number of articles of 10 laws related to security and order.
Accordingly, the Law amending several articles of the Law on Road Traffic Order and Safety stipulates that commercial transport vehicles, tractor-trailers, ambulances, and internal transport vehicles must be equipped with vehicle tracking devices and driver image recording devices. Commercial passenger transport vehicles with 8 or more seats (excluding the driver's seat) must also be equipped with a passenger compartment image recording device.
The government will be responsible for establishing a suitable roadmap for installing devices that record images of drivers and passengers in their vehicles.
Simultaneously, the Law on Road Traffic Order and Safety will be amended and supplemented in the direction that the data management system for vehicle tracking devices, driver image recording devices, and passenger compartment image recording devices used to record, store, and transmit information and data about the journey of vehicles participating in road traffic and images of drivers and passenger compartments will serve the work of ensuring security, order, and safety of road traffic and handling violations of the law, and state management of road transport; it will be managed, operated, and used by the traffic police force; and it will be connected and shared with road management agencies and relevant agencies."
In addition, the government has added a prohibited act: using data obtained from driver image recording devices and passenger compartment recording devices to infringe upon the dignity, honor, privacy, personal secrets, and other legitimate rights and interests of individuals and organizations.

Before the delegates voted to approve the draft law, Minister of Public Security Luong Tam Quang reported on the feedback received, explanations made, revisions and improvements made to the draft law, stating that there are currently approximately 121,041 passenger transport vehicles with 8 seats or more.
The installation of passenger cabin surveillance cameras and driver-recording cameras enhances passenger safety, reduces overcrowding, assists in verifying complaints, protects drivers and businesses from disputes, and increases transparency, reduces legal risks, and improves the quality of transportation services.
Passenger cabin monitoring data also helps businesses manage risks and proactively handle violations or incidents that arise during the journey.
Commercial passenger vehicles do not need to be equipped with child seats.
Regarding driving time regulations, the Law continues to stipulate that continuous driving time should not exceed 4 hours, while adding "except in cases of force majeure or objective obstacles".
The law mandates the Government to research and incorporate regulations into subordinate legal documents to exclude cases of traffic congestion and force majeure, in order to suit the current traffic situation, especially in large cities, and to protect the rights of businesses, traders, and workers.
At the same time, the Law stipulates that the working hours of drivers per day and per week will be in accordance with the provisions of the Labor Code, instead of the current regulations limiting driving time to no more than 10 hours/day and no more than 48 hours/week.
Minister Luong Tam Quang stated that this regulation is consistent with international practice and only applies to drivers of commercial transport vehicles, as they pose a higher risk of traffic accidents than private vehicles; for private drivers, the immediate recommendation should only be to limit driving to no more than 4 hours.
Regarding regulations on safety equipment for children under 10 years old and under 1.35m tall in cars, Clause 3, Article 10 of the current Law on Road Traffic Order and Safety stipulates that it applies to all types of motor vehicles.
Taking into account the opinions of National Assembly deputies regarding the proposal that exemptions should only apply to family cars and passenger vehicles traveling on highways, taxis and service vehicles within the city should be considered for exemption to better suit practical realities.
The new law has been revised to exclude its application to commercial passenger transport vehicles. Specifically, the law stipulates that when transporting children under 10 years old and under 1.35 meters tall in a car, the driver is not allowed to have the child sit in the same row of seats, except in cars with only one row of seats; the driver must use and instruct the driver on the use of appropriate safety equipment for children, except in commercial passenger transport vehicles.
