On the morning of December 4, continuing the 10th Session, under the chairmanship of National Assembly Chairman Tran Thanh Man, the National Assembly gave opinions on the 2021-2026 term work reports of the President and the Government; the draft 15th term work report of the National Assembly... The session was broadcast live on radio and television for voters and people to follow.

Legislative activities are a prominent mark, promptly removing many institutional bottlenecks.

Giving opinions on the draft Report on the work of the 15th National Assembly, National Assembly deputies affirmed that the draft Report has focused on clarifying the outstanding achievements, efforts and continuous reforms of the National Assembly throughout the past term in all areas of work.

Delegate Duong Khac Mai (Lam Dong Delegation) said that the draft Report fully and comprehensively reflected the activities of the National Assembly in a term with a special context, many major fluctuations, from the Covid-19 pandemic, the world economic downturn, to the requirements of economic recovery, institutional reform, organizational restructuring and promoting digital transformation. In that context, the National Assembly has completed a huge amount of work with high requirements on quality and progress.

Delegates especially appreciated the outstanding marks of the term mentioned in the draft Report, especially: the amendment and supplementation of a number of articles of the 2013 Constitution, creating a constitutional basis for many major reforms; a very large volume of legislative activities, promptly removing many institutional bottlenecks; innovation in supreme supervision activities; and the decision on major policies on socio-economy, budget, public investment, recovery and development after the pandemic.

In addition, the method of organizing meetings continues to be flexibly innovated, the National Assembly's foreign affairs activities are expanded, contributing to enhancing Vietnam's position in the international arena.

Sharing the same view, delegate Tran Hoang Ngan (Ho Chi Minh City Delegation) stated that the work of the 15th National Assembly has very well fulfilled its functions and tasks of constitution-making, legislation, supervision and decision-making on important national issues. In the last term, the National Assembly held 19 sessions, including 10 regular sessions and 9 irregular sessions. The 15th National Assembly has implemented discipline in legislative work, completing more than 205 legislative tasks, exceeding the target by 33%.

"The 15th National Assembly is a dynamic and flexible National Assembly, adapting to the requirements of the Party and State in the new context. During the Covid-19 pandemic, the 15th National Assembly flexibly switched from in-person to online, then combined online and in-person and implemented digital transformation, e-Parliament, and digital Parliament in the fastest and most effective way," affirmed delegate Tran Hoang Ngan.

Strong innovation in thinking in law making

Giving comments on the draft Report on the National Assembly's term, delegate Nguyen Thi Thuy (Thai Nguyen delegation) analyzed four outstanding achievements in innovation in law-making thinking during the XV term, namely: innovation in the approach to law-making; reduction of time and procedures in law-making; changing roles in law drafting; innovation in thinking in removing legal bottlenecks.

According to delegate Nguyen Thi Thuy, innovation in the approach to law-making is a very important issue. Immediately after General Secretary To Lam's directive speech at the opening session of the 8th Session of the National Assembly requiring strong innovation in thinking in law-making, turning law from a bottleneck to a competitive advantage, the National Assembly Chairman and the Prime Minister directed every day, every hour to effectively implement the requirements of the General Secretary and the Politburo.

Since the 8th Session, the innovation in thinking in law-making has quickly permeated all stages and steps of the law-drafting process. Instead of the previous requirement of promulgating specific laws to have direct effect, the recently promulgated laws only regulate framework issues, issues of principle and under the authority of the National Assembly.

Specific issues and frequently changing practices are assigned to the Government to regulate, in order to respond flexibly to policies. Instead of the previous thinking that the requirement is heavy on management, the recently enacted laws face the requirement that the law is not only a tool for management, but also a driving force to realize growth.

Delegate Nguyen Thi Thuy also said that the 15th National Assembly term has reduced time and procedures in law-making. Instead of the previous time when most laws were promulgated in two sessions, the Law on Promulgation of Legal Documents now clearly stipulates that in principle, laws can only be passed in one session.

The third highlight analyzed by the delegates is that the roles in drafting laws have changed. Since the beginning of 2025, the law drafting process has been fundamentally innovated and reformed so that: The Government plays its proper role as the agency submitting the draft law and is ultimately responsible for the draft law. The National Assembly plays its proper role as the legislative body, with the right to decide to approve or not to approve draft laws submitted by the Government if they do not ensure quality.

"These innovations and reforms have helped clearly define the position and responsibility of each agency and ensure the continuity of the law-making process. At the same time, they have promoted the critical nature of the National Assembly agencies, which have the right to examine to the end and give opinions to the end, with only one highest goal: ensuring the quality of the draft law," the female delegate of Thai Nguyen emphasized.

The fourth highlight, according to delegate Nguyen Thi Thuy, is the innovation in thinking in removing legal bottlenecks. Instead of the conventional thinking that only the agency that issues the document has the right to amend it, on June 24, institutionalizing the Party's request, the National Assembly issued Resolution 106 allowing the application of a special mechanism to remove legal bottlenecks. On that basis, the National Assembly authorized the Government and the National Assembly Standing Committee to issue Resolutions to amend the laws of the National Assembly.

"I think that in a special situation, there must be a special way to quickly restore stagnant resources. This also responds to the wishes of many businesses that have expressed at many forums that they do not have any lofty aspirations, they just hope for a clear, synchronous, and stable legal corridor for businesses to invest and feel secure in investing and developing long-term," said delegate Nguyen Thi Thuy.

Strengthen early supervision of policy quality and improve re-supervision mechanisms.

With the new requirement that the law only regulates framework issues and issues of principle, in order to continue to effectively implement this Party requirement and continue to innovate thinking in law-making, delegate Nguyen Thi Thuy proposed that the National Assembly Standing Committee soon organize a preliminary review and assessment of the implementation of the above policy in about 100 laws that have been amended by the National Assembly since the 8th Session to date, in order to draw lessons for more effective implementation.

Also recommending solutions to improve the quality of legislation, delegate Duong Khac Mai said that in the coming period, the focus should not only be on continuing to promulgate many laws, but also on the need to shift to the requirement of legal stability, ensuring predictability, feasibility and reasonable compliance costs. The report should emphasize more clearly the need to minimize the situation of laws having to be amended as soon as they are promulgated; at the same time, strengthen early supervision of policy quality right at the law-making stage.

Currently, the law only regulates framework issues and issues of principle, so there will be many issues of policy scope that will be included in the Government's Decree. Therefore, during the drafting process, for policies with a wide scope of impact, delegates suggested that the Government organize to collect public opinions before issuing the Decree.

Regarding supervision activities, delegates recommended that the National Assembly Standing Committee direct in-depth innovation in closely supervising the issuance of detailed regulations by the Government and ministries and branches to ensure that the legislative spirit and legislative will of the National Assembly will be reflected in detailed regulations in Decrees and Circulars.

In addition, delegate Duong Khac Mai emphasized that in the coming time, the decisive issue is to continue to improve the mechanism for monitoring, urging and re-monitoring the implementation of conclusions and recommendations after supervision. Practice shows that if the "post-supervision" stage is not organized and implemented synchronously and closely, the actual effectiveness of supreme supervision is still limited. Therefore, the delegate suggested that the Report should emphasize this content more clearly in the orientation of tasks for the next term, considering this a focus to improve the effectiveness of the National Assembly's supervision.
