The Ministry of Education and Training proposed new regulations on extra teaching and learning. |
The Ministry of Education and Training said that recently, the Party and the State have issued many new guidelines and policies with strong impacts, aiming to promote development and breakthroughs in education and training. Therefore, reviewing and updating legal, political and practical bases in the new context is necessary to adjust and supplement appropriately in the implementation of Circular No. 29/2024/TT-BGDDT (Circular No. 29).
The revised and supplemented contents of the Circular aim to ensure that they meet practical requirements in the management of extra teaching and learning, consistent with the provisions of the revised and supplemented Law on Education ; the Law on Organization of Government; the Law on Teachers and other relevant laws.
More flexibility in tutoring hours in schools
According to Circular No. 29, there are three subjects that are allowed to teach and study extra in schools without collecting tuition fees from students and are only for students who register for extra classes by subject, including: students whose study results for the last subject of the previous semester are not satisfactory; students selected by the school to train excellent students; final year students who voluntarily register for entrance exam review and graduation exam review according to the school's education plan. Regarding the amount of extra teaching time in schools, Circular 29 stipulates that each subject can be organized for no more than 2 periods/week (point c, clause 4, Article 5).
In the process of implementing Circular 29, the Ministry of Education and Training plans to adjust and amend the provisions in Point c, Clause 4, Article 5 of Circular 29 in the direction of allowing more flexibility in the duration of extra teaching in schools, by giving the Director of the Department of Education and Training the authority to decide on cases at the request of the school Principal.
Specifically, the draft Circular amends and supplements, the school principal shall base on the practical conditions of the school (in terms of facilities, teaching staff, time to organize the second session of teaching according to the school's education plan, allocated budget...) to consider the necessity and appropriateness, to add more teaching and learning time for some students of the school to propose to the Director of the Department of Education and Training to consider and decide for the benefit of the students.
This amendment and supplement still ensures the core principles of Circular No. 29 on management of extra teaching and learning in schools: not collecting money from students, not increasing learning pressure, not restricting students' right to study; enhancing and improving the quality of regular school hours, providing time and space for students to experience, practice, and train through educational activities according to individual needs for comprehensive development.
Stricter regulations on reporting of teachers participating in extracurricular teaching
The draft Circular also adjusts business registration requirements for organizations or individuals organizing extra-curricular teaching and learning activities that collect fees from students to comply with the provisions of the new Enterprise Law when diversifying business types.
In addition, the draft adds regulations on regular updates on the electronic information portal or posting at the place where the tutoring facility is headquartered when publicizing information on organizations providing tutoring and learning activities outside of school to increase the effectiveness of timely supervision by society.
The draft also provides stricter regulations on reporting by teachers who are teaching at schools when they participate in extracurricular teaching. Accordingly, teachers must report before starting and update the report when there is a change in one of the report contents. This regulation aims to strengthen the management responsibility of the Principal.
Towards eliminating "achievement disease" in education
Draft Circular amending and supplementing the responsibilities of the People's Committee at the commune level (transferring the responsibilities of the previous district-level People's Committee to the People's Committee at the commune level) and at the provincial level to comply with the Law on Organization of Local Government No. 72/2025/QH15 dated June 16, 2025.
The Ministry of Education and Training said that the amendment and supplement to the Circular continues to affirm the spirit of serving the interests of students, in accordance with the Law on Teachers No. 73/2025/QH15 when strictly prohibiting teachers from "Forcing students to participate in extra classes in any form", preserving the image and dignity of teachers according to the provisions of the 2019 Law on Education on prohibited acts in educational institutions; contributing to ensuring legitimate and fair interests among teachers teaching different subjects in schools; helping students eliminate the tendency to emphasize certain subjects, aiming to eliminate the disease of achievement in education.
