The Ministry of Education and Training said that in recent times, many major policies and guidelines of the Party and the State have been issued to promote fundamental and comprehensive innovation in education and training. In that context, reviewing and updating legal regulations related to extra teaching and learning is necessary to ensure consistency with new laws such as the revised Law on Education, the Law on Teachers, the Law on Organization of Local Government, etc.
One of the highlights of the draft is the proposal to be more flexible in terms of the amount of extra teaching time in schools. According to the current Circular 29, each subject can only be taught a maximum of 2 extra periods per week for three groups of subjects: students who have not met the requirements, excellent students and final year students who register for exam preparation. However, many opinions from localities and schools believe that this regulation is not enough to meet practical needs.
The new draft allows the Principal to propose additional teaching time for some students based on the physical conditions, teaching staff, second-session teaching plan, etc. The final decision belongs to the Director of the Department of Education and Training, ensuring the principle of "for the benefit of students" and not collecting fees from students.
The Ministry of Education and Training emphasized that despite the flexible adjustments, the core spirit of Circular 29 remains the same: not increasing learning pressure, not restricting students' right to study, while focusing on improving the quality of formal school hours and creating conditions for students to experience and practice comprehensively.
Regarding extracurricular teaching activities, the draft Circular stipulates stricter requirements for business registration to comply with the new Enterprise Law. Extracurricular teaching establishments must publicly disclose information on electronic information portals or post it at their headquarters to increase transparency and serve social supervision.
For teachers who are working in schools but teaching outside of school, the draft requires teachers to report before starting to teach and update when there are changes. This regulation aims to strengthen the school's management responsibility and limit the rampant situation of teaching outside of school.
The draft also adjusts the management responsibilities between local government levels in accordance with the new Law on Organization of Local Government. In particular, the revised content continues to affirm the viewpoint of strictly prohibiting forcing students to take extra classes in any form, in accordance with the Law on Teachers and the Law on Education , aiming to protect the image of teachers and a healthy educational environment.
