Amending regulations on extra teaching and learning towards eliminating achievement disease in education

The Ministry of Education and Training (MOET) has begun soliciting comments on the draft Circular amending and supplementing Circular No. 29/2024/TT-BGDDT dated December 30, 2024 of the Minister of Education and Training (Circular 29) regulating extra teaching and learning.

More flexible in tutoring hours

The draft Circular clearly states the revised and supplemented contents of the Circular to ensure that it meets practical requirements in the management of extra teaching and learning, consistent with the provisions of the amended and supplemented Law on Education ; the Law on Organization of Government; the Law on Teachers and other relevant laws.

According to Circular No. 29, there are 3 subjects that are allowed to teach and study extra in schools without collecting tuition fees from students and are only for students who register for extra classes by subject, including: students whose study results for the last subject of the adjacent semester are not at the standard level; students selected by the school to nurture excellent students; final year students who voluntarily register to review for entrance exams and graduation exams according to the school's education plan.

Regarding the amount of extra teaching time in schools, Circular 29 stipulates that each subject can be organized for extra teaching for no more than 2 periods/week (point c, clause 4, Article 5).

In the process of implementing Circular 29, receiving comments and recommendations from many voters, organizations and individuals, the Ministry of Education and Training plans to adjust and amend the provisions in Point c, Clause 4, Article 5 of Circular 29 in the direction of: allowing more flexibility in the duration of extra teaching in schools, by giving the Director of the Department of Education and Training the authority to decide on cases at the request of the school Principal.

Specifically, according to the draft Circular amending and supplementing, the school principal shall base on the practical conditions of the school (in terms of facilities, teaching staff, time to organize the second session of teaching according to the school's education plan, allocated budget...) to consider the necessity and appropriateness of adding more teaching and learning time for some students of the school to propose to the Director of the Department of Education and Training to consider and decide for the benefit of the students.

This amendment and supplement still ensures the core principle of Circular No. 29 on management of extra teaching and learning in schools, which is "not collecting money" from students, not increasing learning pressure, not restricting students' right to study; enhancing the quality of regular school hours, providing time and space for students to experience, practice, and train through educational activities according to individual needs for comprehensive development.

Tighter management of teachers teaching outside of school

The draft amended and supplemented Circular also adjusts business registration requirements for organizations or individuals organizing extra-curricular teaching and learning activities that collect fees from students in order to comply with the provisions of the new Enterprise Law when diversifying business types.

The draft Circular supplements regulations on regular updates on electronic information portals or posting at the headquarters of the tutoring facility when disclosing information on organizations providing tutoring and learning activities outside of school to increase the effectiveness of timely supervision by society.

The draft Circular also provides stricter regulations on reporting by teachers who are teaching at schools when they participate in extra-curricular teaching. Accordingly, teachers must report before starting and update the report when there is a change in one of the report contents. This regulation aims to strengthen the management responsibility of the Principal.

Get rid of "achievement disease"

The Ministry of Education and Training also said that the Draft Circular amends and supplements the responsibilities of the People's Committees at the commune level (transferring the responsibilities of the previous district-level People's Committees to the People's Committees at the commune level) and the provincial level.

The amendment and supplement to the Circular continues to affirm the spirit of serving the interests of students, in accordance with the Law on Teachers when strictly prohibiting teachers from "Forcing students to participate in extra classes in any form", preserving the image and dignity of teachers according to the provisions of the 2019 Law on Education on prohibited acts in educational institutions.

"The amendment and supplementation of Circular No. 29 also contributes to ensuring legitimate and fair interests among teachers teaching different subjects in schools; helping students eliminate the tendency to emphasize certain subjects, aiming to eliminate the disease of achievement in education," according to the Ministry of Education and Training.
