
The resolution stipulates that the management of revenue sharing and the percentage (%) ratio between the central and local budgets from the exploitation of land in TOD areas is as follows: for local railway projects following the TOD model that use the entire budget of the City or advance capital from the Investor to carry out compensation, support, and resettlement for the land acquired for the railway and TOD area, the City is allowed to retain 100% of the revenue collected from the exploitation of land in the TOD area to prioritize investment in local railway projects and transportation projects along the TOD route.
The resolution states that the Ho Chi Minh City Free Trade Zone is a geographically defined area established to pilot superior, groundbreaking mechanisms and policies aimed at attracting high-quality investment, finance, trade, and services to promote exports, industry, research and development (R&D), and high-quality human resources.

Free trade zones are organized into functional areas including: production zones, port and port logistics zones, logistics centers, trade and service zones, and other types of functional zones as prescribed by law. Functional zones within a free trade zone that meet the conditions of a duty-free zone as prescribed by law are guaranteed customs inspection, supervision, and control by customs authorities and state management activities in the corresponding fields by relevant agencies as prescribed by law.
Regarding the authority and procedures for establishing a Free Trade Zone, the following is stipulated: The City People's Council shall regulate the procedures for establishing, expanding, and adjusting the boundaries of the Free Trade Zone.
The People's Committee of the City decides to establish, expand, and adjust the boundaries of the Free Trade Zone associated with the Cai Mep Ha seaport area; the decision to establish, expand, and adjust the boundaries of the Free Trade Zone is considered a decision to make local adjustments to the City's General Planning and the City's Master Plan. The People's Committee of the City shall update these plans accordingly.
The People's Committee of the City performs the tasks and powers of state management regarding the Free Trade Zone in accordance with the law on the management of industrial parks and economic zones.
The Ho Chi Minh City Export Processing Zones and Industrial Parks Management Board is an agency under the People's Committee of Ho Chi Minh City. In addition to its assigned functions and duties as stipulated by law, it also performs the functions and duties of direct state management over the Free Trade Zone.
The People's Committee of Ho Chi Minh City has decided to transfer some functions, tasks, and powers of specialized agencies under the People's Committee of Ho Chi Minh City to the Management Board of Export Processing Zones and Industrial Parks of Ho Chi Minh City.
The resolution takes effect from December 12, 2025.
