Ending the abuse of criminal record requests
Delegate Dong Ngoc Ba ( Gia Lai delegation) highly appreciated the spirit of the draft law, especially the goal of overcoming the widespread requirement for Criminal Record Certificates (LLTP) in many transactions and procedures.
He said many previous legal documents forced individuals to submit LLTP forms without clear grounds, creating procedural burdens and affecting citizens' privacy.
According to delegates, there are two reasons why this requirement is abused: there are still a series of regulations requiring the submission of a temporary residence card but they are not based on unified criteria; many agencies and organizations have formed the habit of requesting the card to "be sure", even in normal civil transactions that do not involve legal risks.

He suggested that the draft law must establish a strict criteria framework to determine cases where it is permissible to request a criminal record certificate - only applicable to specific professions such as finance, security, etc. At the same time, in civil transactions, if an organization requests criminal record information without a legal basis, it must be considered illegal.
Besides, delegates also highly appreciated the draft's determination in digital transformation.
"In addition to the form of issuing electronic criminal records, we advocate integrating and connecting criminal records data with the national identification database, which will help people immediately use that identification information to prove their judicial status, without having to apply for a certificate. This is a very important step forward," said delegate Dong Ngoc Ba.

Sharing the people's difficulties, delegate Nguyen Hai Nam emphasized that applying for a temporary residence card currently takes many days, causing obstacles for applying for jobs, appointments or carrying out procedures at ministries and branches.
He proposed to accelerate the model of electronic criminal records, allowing people to authenticate their identity and receive instant results, similar to countries that have deployed "electronic criminal ID". This, he said, if combined with data integration into VNeID, will help shorten the time to issue the Certificate to a few hours or less than a day.
Delegates affirmed that reducing dependence on paper forms and switching to data integration is completely consistent with the spirit of cutting administrative procedures and digital transformation directed by Party and State leaders.

On behalf of the drafting agency, Minister of Public Security Luong Tam Quang said the Ministry will fully absorb the opinions of National Assembly deputies, especially the request to minimize the abuse of the request for LLTP form No. 2, ensuring privacy and the right to reintegration of people with criminal records.
The important new point emphasized by the Minister is that the draft will be revised in the direction of updating criminal record information directly to VNeID, with legal value equivalent to the LLTP card. At that time, the citizen's criminal information will be displayed as a basic data field; competent authorities will be exploited through data connection, without requiring people to submit forms.
"This information is applied with security technology to prevent forgery and electronic ballot authentication mechanism for unified implementation by agencies," said Minister Luong Tam Quang.

The Minister of Information and the Ministry of Public Security have completed the National Population Database and are coordinating with ministries, branches and localities to build a "correct - sufficient - clean - alive", unified and shared data system.
"We will fully update the information fields on VNeID. As soon as VNeID is fully updated, we will propose to the National Assembly to abolish the Law on Judicial Records," the Minister emphasized.
