(Chinhphu.vn) - This is a requirement from the Ministry of Health after discovering several negative incidents and serious violations of the law at the Central Institute of Forensic Psychiatry, the Central Institute of Forensic Psychiatry in Bien Hoa, and the Northern Mountainous Region Forensic Psychiatry Center, which have caused public outrage recently.

Strengthen the management of individuals required to undergo mandatory mental health treatment and ensure objective and transparent assessments.

According to Minister of Health Dao Hong Lan, the reason for some negative incidents and serious violations of the law at some forensic institutes and centers is that some leaders and medical staff have not strictly implemented the regulations of the law, professional guidelines, and directives of the Ministry of Health and other ministries and sectors.

Some unit leaders and medical staff have not set a good example, have not maintained their political integrity, and are easily bribed or lured into participating in criminal acts or assisting criminals in violating the law.

To address these shortcomings and limitations, ensure continued improvement in the effectiveness of forensic examination activities, and promptly prevent negative behaviors in handling work, Minister Dao Hong Lan requested heads of units to thoroughly understand and strictly implement legal regulations, professional guidelines, and directives from the Ministry of Health and other ministries and agencies; maintain political integrity, and not allow malicious individuals to bribe or entice them into participating in criminal acts.

In particular, the Minister requested the immediate and serious implementation of directives to strengthen state management responsibilities for units assigned the task of carrying out forensic examination, forensic psychiatry, and compulsory treatment.

Strengthen supervision, professional guidance, and coordination with relevant agencies to tighten management of individuals required to undergo compulsory mental health treatment, ensuring objective and transparent assessments to meet the assessment needs of judicial bodies, organizations, and individuals.

Strictly enforce the regulations in Government Decree No. 64/2011/ND-CP on the implementation of compulsory treatment measures and professional guidelines, as well as regulations of the Ministry of Health related to compulsory treatment; strictly enforce regulations on the management of patients undergoing compulsory treatment, preventing patients from leaving compulsory mental health treatment facilities or escaping from treatment, which could endanger society and lead to continued criminal behavior.

The head of the organization is responsible if any wrongdoing occurs.

Psychiatric hospitals and medical facilities with a scope of professional practice in mental health must strictly comply with regulations on professional standards and regulations on issuing summaries of medical records and health certificates (including information on mental status); preventing individuals from exploiting these documents to request that prosecuting authorities send defendants or convicted persons for psychiatric evaluation in order to evade or mitigate criminal responsibility when committing crimes.

At the same time, strictly implement the requirements of the Ministry of Health regarding strengthening management in the fields of forensic examination, forensic psychiatry, and compulsory mental health treatment. The head of the unit will be fully responsible before the law if any violations occur within the unit.

Promoting the application of information technology and digital technology in management and professional work in the fields of forensic medicine, forensic psychiatry, and compulsory treatment. Investing in infrastructure, equipment, and facilities to serve forensic examination, forensic psychiatry, and compulsory mental health treatment in a synchronized, modern manner, in line with the development trends of the specialty and meeting professional requirements.

Recently, in the fields of forensic examination, forensic psychiatry, and compulsory mental health treatment, several incidents have occurred, such as bribery, receiving bribes, brokering bribes, organizing the illegal use of narcotics in forensic examination and compulsory treatment facilities, falsifying mental health records, etc., causing public outrage.
